I am not asking for advice but this is an argument i heard in work which interested me.

If someone sends a photo to a paper which is not commissioned and they use it do they have to pay the person who took it. One person says no as no contracts exists. The other says they do as the photographer owns the copyright

There is no correct answer. Some papers say that any images submitted are for use without fee. But, if you want to be paid, then when you send in the image simply state that "standard payment rates apply", and when you invoice after usage you will be paid.

Papers love free, so will gladly take images submitted when no payment terms are expressed.
