    Since the Amendments to the Building Control Regulations, Can an Architectural Technician lodge a planning application to a local authority?

    After planning, i know it will then pass on to the Assigned Certifier.

    There is nothing to stop an AT lodging a planning application, even if the proposed works fall under the new regulations.

    I would suggest that any AT submitting a planning application should inform the client at the outset that AT's are not currently in a position to fill the statutory roles set out under current Building Control Legislation, to allow them the opportunity of selecting one professional to take their project from start to finish.

    However, that person may subsequently be asked to provide ancillary certification to the Design and Assigned Certifier once they are appointed - that is entriely at the discretion of the professional filling those roles. You should ensure that your insurance covers you to do this.

    In your experience, can the assigned certifier carry on without any compliance cert from the arch tech who lodged the planning application. Can they then place themselves as the design certifier instead?

    If not, is there an official 'cert of design compliance', as i cant find one on the BCMS website?

    No. Arch Techs cant complete any of the Statutory Certificates. These can only be completed by a Chartered Engineer, a registered Building Surveyor or a registered architect.

    Some ACs will take on the role of Design certifier but because of the extra risk and responsibility expect extra fees. Ther eis a final ancillary certificate for the design that gets submitted-you will find it on Engineers Ireland website, The RIAI or RICS.
