    So if I put it into my sons name am I still insured to drive on the insurance policy which is in my name only

    No, your insurance company will deem that you have sold or gifted the car to your son and your policy will be voided as a result. He will need to take pout a new policy and name you as as driver.

    I suspect there are easier and (legally) less dubious ways of achieving what you're trying to do.

    if this is a case where you are trying to move assets out of the reach of creditors you might be opening a whole can of worms ... as far as I know these sort of asset transactions while there is a claim from a creditor can be viewed very very negatively by the courts.

    Actually it is a customs charge of €7 which has changed into €32 by debt collectors whom are now threatening court. As the item in question was a replacement for a faulty one I don't see why I should pay the duties twice. In other words I am digging my heals in . I have an invoice from the seller showing a zero charge to me and I was not notified by fedex of any duties owing prior to delivery as they always did on previous shipments!!! If I had known there were duties to pay I would have contacted the seller and asked for a letter from them. This worked before and duties were waived. I only have a bike in my name and just wanted to protect it is all.
    Yes I know what customs say but I say screw them!!!!

    Renting. The fact of the matter is that there is a process in place to recover debt is there not. In any country right. If you don't pay its passed on to debt collectors. If you don't pay them then they land you in court, If the court make a judgement against you and you refuse to pay them they go after assets. Is that not he procedure. If there are no assets then its jail not so?

    What do you guys think we all can go around not paying what we owe is that it?

    On top of the 32 will be huge lawyers fees also so it gets bigger and bigger right!!!!!

    You may find the sheriff engaged, they're about as effective as a chocolate teapot in domestic claims. No one is going to go to court for €32.

    Its 32 (for starters) I owe revenue and there principle is that it must be paid. There are not afraid to send lawyers after me as they know their fees will be paid by me!!! My principle is that I paid it already!!!

    You've very little to worry about, certainly don't start signing things over.

    Legal advice can't be given here so speak to FLAC and get some proper legal advice.

    If you have paid any custom due on the first item and the second item was sent as a replacement and no cost to you, then you have no customs to pay at all. A simple letter and a receipt/invoice showing €0 paid then it's sorted. It's really that simple.

    I think it's bull tho as An Post handling fee is €7 alone on top of whatever customs is due and no courier will release item without payment either in advance via card or cash on delivery. I've not heard of anyone receiving a package and then paying customs at a later date.

    I produced an invoice with a zero balance AND the total emails over and back to the seller where he states that they will send a replacement free of charge. I took delivery from fedex and a week later received an bill for €7. The rest is history and all the emails over and back from me to fedex, customs ie and control accounts have brought me to this point.
    The fact still remains that as far as I am aware they can get there pound of flesh whether its 32 or a million €. I hope I'm wrong in my case because I think its a disgrace to have to pay duties twice on the same item!! I find it very infuriating after living my life and seeing all the skulduggery that's gone on that this is allowed to happen and no amount of pleading seems to matter any more. All someone in customs could have done was to look at the matter and agree that a mistake was made and sing off on it!

    Yes that an post thing is a disgrace also. I got caught several times before realising it.

    I did start it to be fair.

    That said I've not put an opinion forward that you agree with, they've all been relatively 'good' one or two of them even had a clue.

    You're suggesting transferring ownership of of your car over a €32 debt. People have had thousands in debt and the sheriff has refused to enforce. Have a google. I'm sorry to have been flippant but you're bordering on wearing a tin foil hat.

    With the "LITTLE" you had to offer your comments are superficial at best. You obviously didn't understand what was being asked! The first posters were able to look deeply enough to make sensible comments.
    I think you are just one of those people who sits on there couch all day and inter-fears / hijacks and confuses the topics brought up on forums just to make your life worth while.
    I got the info I needed to satisfy myself about the course of action I must take. €32 can go to big money here if one is not careful and broad, fleeting, uneducated and sarcastic statements as you have made don't come close to allaying any fears.

    Being charged twice for the one item; not on my watch!!!!! I'll not be steam-rolled by customs or fedex if I can help it.

    I said retired not unemployed! All I do these days is fix things for people for FREE. Its where my heart lies!!!

    Nobody is going to take you to court over €32. The small claims court would barely be interested, tbh. A court case over that amount (particularly from a large international company like FedEx) would be laughed out of court, imo.

    Calm yourself down. You don't need to go moving assets anywhere. Besides, with the cost of getting a new insurance policy if you did transfer ownership, it'd be cheaper to just pay them the thirty quid - principles be damned!

    Ignore it or ring them back, ask to speak to a manager or supervisor, and tell them (politely) to shove it as you have proof it was paid.
