Hit and run :(

Someone did a hit and run on my car damaging the back of it yesterday.
My car was and still is parked in front of my house.

I later found this car abandoned in the cul-de-sac, no sign of the driver.

I have photos of both damage and the car.
I can prove that the this was the car that damaged mine - there are parts of this other car next to my car..

I am waiting for guards to take my statement in regarding to this.

My insurance is 3rd party, not comprehensive.

I was told by a colleague that I should not move the car until guards come, because If I do I wont be able to claim for the damages?

Any ideas if I can claim of the other car's isurer or some goverment body?

Or should I just go ahead and start fixing the car...? and forget about calling this in? I will nearly be 24hours since I called the guards, so they dont seem to care.

    Thanks in advance.

Get onto your insurance report it.

Get details off other car and report to their insurance company.

Keep all parts as proof and take as many photos as you can of everything before you move your car.

Probably someone was on the sauce last night and got away from car as quick as they could.

If you need a solicitor that deals with these things let me know I am still going through a collision had a few years ago.

What did your insurance company say?

Did the car have an insurance disc? Have you contacted your own insurance company?

  • Registered Users, Registered Users 2 Posts: 453 ✭✭Shiranui

The car did have an insurance disc alright. It was valid 12-14

Not to de-rail the thread but who in their right mind would hit something and ditch the car, leaving a paper trail. Unless it was stolen of course which is always a possibility.

Complete nonsense. Your colleague is probably one of these morons who has a small bump and backs up half of Dublin at rush hour waiting for the guards to arrive.

One piece of advice is when you ring the guards don't ring the local station ring 999. You will be guaranteed a response. I don't know the full ins and outs of the system but they have to show a response to a 999phonecall

    Thanks.

My insurer asked me to call the insurer of the other car. Will do that on Monday.

Once it's been established that this vehicle was at fault, regardless of whether the driver of that vehicle is insured or not you will be covered by the Motor Insurance Bureau. You will not lose your no claims bonus.

999 and 112 are emergency numbers. They should only be used when you need urgent assistance from the emergency services and not to report a relatively trivial traffic collision.

I'd talk to a solicitor and see what he says but get the guards involved, take plenty of photos too, they would be invaluable as proof.
Out of curiosity how much damage was done to your car.

Is a hit and run not considered an emergency?

  • Registered Users, Registered Users 2 Posts: 453 ✭✭Shiranui

    Not that much I think.
The back bumper is "crushed in", so swapping this part + back tyre is flat for some reason.

Nope. Not when the damaging event is over and there is no situation that poses an immediate risk to health, life, property, or environment.

If it had just taken place and someone was in need of an ambulance or the car was teetering off an overpass, then you'd have an emergency.

If the driver was still going down the road colliding with other cars and possibly putting others in danger then it would be appropriate.
But in the type of incident described by the OP there is no emergency, the offending car is parked up, driver disappeared, rampage over. It would be a misuse of the emergency number for the OP to call 999/112 for this type of incident and especially if he called it now considering the incident occurred the day previously.

First port of call is the guards. Once they're satisfied of the circumstances the MIB will liaise with them.

Click here to get to their website which has a very simple form to fill out.

Many people have used this without the need for a solicitor. If you have any doubts contact the guards and the MIBI who will explain it to you in greater detail.

However when I got hit by another car(minor damage to mine only), we moved the cars to side of the road, the gards were called but when they got there the other driver denied ever hitting me. Gards wouldn't get involved because cars were moved and they didn't witness the incident.

  • Closed Accounts Posts: 6,219 ✭✭✭pablo128

The best thing to do is to go to the local garda station with all of the details. Then get on to your insurance company. The guards won't decide on the outcome, they leave that to the ins company. But the ins company will liase with the guards to determine the other cars ownership and insurance.

Holy christ. I seen someone parking in a disabled spot at Tesco and their disabled badge was upside down. Call 999

Guards won't get involved in something that doesn't involve injuries. They won't do anything to influence the Insurance companies in a fender bender.

Best thing to do is take a couple of pictures for your insurance company and move the cars if they are causing an obstruction.

Its 112 and its for emergencies only. A small bump and tip with no one injured is not an emergency, ties up there time and its completely unnecessary. Gardai are not required the cars unless someone is getting aggravated, appears drunk etc. In all instances, the insurance company will determine fault anyway. Otherwise, settle it like decent human beings, swap some details and just get on your way. We pay for insurance for these things.

An assessor once told me before any car is moved take a load of pictures from all angles and advise the other party to do the same.

If the other driver never hit you, why did he wait for the guards

To be fair, he was a nut job and as the guards were leaving he threw cash in my car to get the few scratches fixed and treatened to follow me to my grave for the money, so quick beep of the horn, ...gards returned, had a stern talk with your man while they left me on my way.

Your own insurer will not deal with the other insurer unless a) someone has lodged a claim against you or b) you are claiming under your own policy and your insurer is seeking a recovery.

As the OP has 3rd party only cover, they won't get involved

Not true. I was rear ended a few months ago. i informed my insurance company FBD of the accident. they took all the details and said to me if there was any issue with the other insurance company , to tell them and they would step in

Probably meant that they would pay under your own policy and seek recovery from the 3rd party insurers. Your own insurer will not (normally) pursue a claim for their own policyholder unless they are involved in it by way of defending a claim against you or seeking recovery

Third party Fire and Theft covers you for loss or damage you cause to a third party or loss or damage sustained to your vehicle as a result of theft and or attempted theft or fire.

No claim for his insurer to be dealing with so no need for them to be involved.

Are you sure of this, what if it is a case of the car was stolen. I know if you know who did it and they are not insured the MIB will pay but what happens if the owner reported it stolen before the time of the accident, or for example it was sold but cert handed over instead of sent off.

What happens if car is known but driver not?

  • Registered Users, Registered Users 2 Posts: 453 ✭✭Shiranui

So far I am waiting for other car insurer to decide if they are going to take it on or not. If not my failover strategy is MIBI :)

    Tks for all comments.

If it's valid 12-14 does that not mean it expired at the end of last year?

Sorry for confusion. The disc expiry date was in 2015 so looked valid, but the original insurer have allegedly sold the car, which makes the disc invalid. We are pursuing this with MIBI.
