Suspicious driver crashed into me and fled the scene

    It happened during snail pace traffic on a one way street. He was coming out of a T-juntion onto this main street(which I was on) and drove into the back of my car(I was in front) when cutting across a lane to get into the far lane. I felt a sudden jolt and heard a loud bang. It wasn't even the case that I had just stopped suddenly. There was significant damage done to the back left of the car. We both got out of out cars, and I said I'll need to take your details. As I walked back towards my car, he shouted "don't worry, I'll pay ya" and was reaching into his pocket. I then said "you're not drunk are you?". He then seemed to panic, and got back into his car and fled the scene. I managed to get the number plate and noticed a helpful man on the side of the street who said "if you want to just pull over your car". I found a place to pull over and phoned the guards. As I was on the phone I realised that the helpful other man had reported it too.

    He said I should go to my doctor and say that my back is killing and get a report. He said that I should say that I want €1,500 compensation. I think what he meant by this is that, "I want €1,500 off him or I'll go to court". This man said I shouldn't have got out of the car and then called an ambulance. That way the offender would be in a lot more trouble him He gave me his number so I'd have him as a witness. He also said the back is a very ambiguous area to diagnose so I could easily fake an injury. I think this man was a lawyer by the sound of it, but I didn't want to be completely dependent on him as he'd already given me enough of his time... hense I didn't ask if he was lawyer.

    I'd somewhere I'd to be for 2 hours, so I made the judgement call to go there instead of waiting for the guards, since the gaurd on the phone said it didn't make a difference now whether I reported it later or not... giving that the offender had fled. I then called to the guarda station afterwards. Gave the guard there the reg number too, the phone number of the witness and so on.

    When I mentioned that my back was in pain, he asked did I mentioned that to the guard on the phone. I thought carefully for a second, and said 'no'. I then said that I failed to mention it because I was in shock at the time. He said "it's a bit different coming in here 3 hours later and saying that your back is sore, because you know.. you could be lying!". I have had three physios for a back problem over the last month anyway, which I recently recovered from. So I mentioned to the guard that it had brought that problem back. So I guess there's no point in trying to argue that the crime created a new problem if the problem was already there. The lawyer's advice sounded strong at the time but so I said I'd mention something of how I wanted the "€1500" before I left the station. I then said "I need to be fairly compensated, and I think that... you know maybe one or two grand". I don't know how that looked but the guard more or less ignored that comment and continued on talking.

    The gaurd photographed the car and looked at my insurance, but the insurance disc is not enough as always, so I've to come back in. The guard said he couldn't take a statement off me then because he was the only guard on duty. I also reported it to my insurance company even though I'm only on 'third party fire'. So it looks like the motor insurance bureau of Ireland will be able to claim it off his insurance company if he's even insured. I know people might say that I could stand to be compensated in this situation, but unfortunately I don't know a lot about the law so don't know how to play my cards right... whether it's worth going to court, or just letting the MIBI sort it out. In my past experiences of reporting crimes, it's often been more hassle than it's worth reporting them, but I hate just letting something like this go.

    Heading to the doctor soon so I hope I know what I'm doing. Has anyone had any similar experiences in situations like this? Thank you

    You're obviously disoriented after your accident. I'm no expert but I reckon your back is broken and you're going to make billions off of it.

    So tldr you were in an accident and now you're trying to commit insurance fraud by claiming a spurious back injury in the hopes of securing more compensation? Aren't you great.

    It isn't often that you get to screw over a truly reprehensible person. If he hadn't fled the scene.....

    Besides, lets not forget that the reason competent drivers' insurance is high, is because of fools like this anyway.

    At what point did the witness ask you for your AC and PIN to arrange payment on a no win no fee basis?

    None AH answer...

    If this is a genuine issue, you really need to be talking to The Guards, your Insurance, or a Lawyer. Maybe rethink the bad back part though.

    Jesus where to begin, is your back sore or not. Get the car valued for repair and follow for this amount. No wonder insurance is so expensive in this country. Putting aside the other guys inexcusable actions of driving off, some people see a car accident like getting six numbers on the lotto.

    back pain may not occur for a day or 2 so don't worry that it wasn't mentioned.
    my advice is let your insurance deal with the claim and the guards with the hit and run. you have a regular number so your covered.

    but please please ignore any edjit that suggests you should profit or exhadurate your injuries, that's so wrong and could easily backfire.

    hopefully the guy was insured and you done develop any complications, but I'm guessing this was a low speed hit which helps.

    And because of bogus claims driving up insurer costs.

    Besides. If he's uninsured you won't be screwing him by claiming. The MIBI will pay regardless. It is up to the Gardai to punish him.

    If you are injured, claim for it. If not, don't.

    You've reported him and the car registration to the Garda, let them do their job, if you have back pain or not won't affect the outcome to his prosecution.
