should I take legal action against sony?

    Hi guys just looking for some advice. About two months ago I was using my sony earphones with my sony phone. About a day later I released I had pain and alot of wax in my right ear. At first I thought it was a build up of wax from listening to music so got drops from tje chemiat which didnt work. Today I went to my doctor who spent 20 cleaning out the wax while doing this she part of the earpiece from the earphones was lodged in my ear and gone right to the ear drum she successfully removed it. I am just wondering would I have any case against sony for the 8 weeks of pain or would it even be worth my time getting onto them at all. Any advice welcome

    I doubt you have a case unless you can show that its sony's fault that a piece of your earphones came off.

    You would have to prove that you put the earphones in correctly, as per instructions, and that the earphone was then faulty, causing the earbud to stick in your ear.

    The norm is that they come with multiple sizes of buds as well, could be argued you were using ones that were too small or that the whole thing was an ill fit for you personally.

    Well they were the earphones that accompanied the phone. It could have damaged the ear permanently ye think theres any point contacting sony?

    You would have to prove it was Sony's fault.

    So when the time comes to go to court you would have to have some experts testify on your behalf that your pain was caused by Sony's negligence. They wouldnt come cheap, you would have to pay them and their expenses.

    Plus, Sony is not going to rollover and admit something is their fault and thus open themselves up for every tom dick and harry to then sue them. They will fight you with every legal means possible, which means they will use their own extremely well paid team of lawyers to discredit your evidence. For instance how did you come up with 8 weeks of pain? How would you go about proving in a court of law that it was 8 weeks and not 6? Or 5? Do you still have the piece that your doc removed? Obviously that would be essential too, it would have to be examined.

    Sony could equally argue that the build-up of wax damaged the ear piece

    Take a pic of the piece that got stuck in your ear and the earphones themselves showing where the piece broke off and post it here for us to see?

    Hey flynn29,
    people have sued companies for less and won. However, we're talking about the giant corporation Sony here. Who have a team of lawyers for every region they operate in. All who wrote great terms and conditions, usage guidelines and the likes all coming out of the wazoo.

    You need to get your story straight for court. You said a day after you started using them this happens. it takes weeks for wax to build up.

    So let me get this straight;
    1. You claim you had pain and a lot of earwax buildup due to a day of listening to music

    2. You did not notice that when you took the ear-buds out you were missing a piece, nor did you care to pay attention next time you put them in

    3. You managed to go on for a month before you decided to visit a doctor


    Then can you prove that;
    1. Ear wax builds up because you listen to music
    2. The ear wax was not there before you put the ear-buds in
    3. It was not the ear wax that caused the piece to get stuck to begin with



    In short;
    You stand no chance of getting any sort of claim in here...

    So, the day after you used the earphpones you had pain. Did you just ignore the pain? Did you not see the headphones were missing an ear piece? Why did it take you 8 weeks to seek medical attention?

    How did part of the earphone get right to the ear drum? Was it pushed in by something else?

    So far, your story seems more like you either didn't use them properly, didn't pay attention, ignore the pain for 8 weeks, and now, from your recent post, don't even have the proof that a piece came off and was in your ear.

    I honestly doubt you would get very far with Sony.

    Legal action, I wouldn't.

    But no harm lashing off an email to their customer service department (or that of your mobile provider). They might gift you something...

    Didnt notice it was missing till the next day so jus presumed I lost it. Ya to be honest I just ignored the pain thinking it would eventually go away im not one for the doctor today was my first time in 8 years. Should I at least report it sony

    Of course you should tell Sony. If the phones are defective, there's a chance it could happen to someone else and your silence could allow that to happen.

    A letter to Sony with a picture of the earphones and the piece recovered is a good idea.

    As a poster said if the product is defective its worth them knowing
