likely jail sentence

    ok i had a bit of banter on facebook with a cousin of mine hes 18 with no previous,it got a bit serious and he made a few threats etc.that was that.

    Last week he came to my house and put a brick through the car window and threw in a petrol bomb and set it alight.

    I put the fire out and he was caught down the road by garda.damage was estimated at 2000 euro.

    My question is will the judge order him to pay.if he doesnt will he get jail.

    He has already bin charged for criminal damage by arson and garda has already said facebook messages doesnt come into it.

    your thoughts please

    Should have been charged with attempted murder and the Facebook messages should be used to show premeditation. DPP going with the easy option I guess. With luck your cousin will get a few years for the arson.

    With the help of god he will,unless hes given the option to pay for the damages and get a suspended sentence which his mother will end up paying.

    Prosecuting garda and sergeant says the facebook messages was 'banter' which turned serious

    Only in Ireland. Why would you be hassling your cousin on Facebook. Banter? You must have been humiliating him on there?
    What a guy. And now you want your cousin to go to jail ? Are you ok in the head ?
    You should be trying to help him, you are to blame too .

    Ah, but the OP didn't put a brick through the car window. Or set fire to his house, did he? Banter is one thing. Vandalism, and much more seriously, arson/attempted murder is quite another. And it needs to be acknowledged and dealt with as necessary.

    Sounds as though the cousin has real issues.

    It wasnt hasslling him.it was private messaging..slagging that got out of hand that lead to threatening messages.

    His line of messages was ill rob your car,smash your skull etc my reply was you wouldnt say that to me in person.

    Have him on cctv it was a serious act for no real reason at all

    I hate to break it to you but unless he admitted to it, being down the road from a burning car is no proof he did it.
    He gave a full confession in his statement..he says he made the petrol bomb at home..walked a mile from his house to mine and done it.
