I am considering applying for planning permission . I have to satisfy local housing need. I am hesitant to provide medical information in case it's disclosed to the public or available on request with FoI request . Is my private information protected or available to all to see

Aside from your contact details, everything else submitted with your planning application will be available for public inspection, and in most cases can be downloaded from the Planning Section of the local authority website by any member of the public.

You can request that certain sensitive info be removed from the public application and be made only available to the planning officials.

In a similar situation we had a planner allow us to show them our client's medical info - they then noted on the file that they had seen it but didn't keep a copy.

We asked for this another time and it wasn't allowed at all!

    It's worth a try!

I applied under the 'Returning emmigrant' clause, had to prove living in UK and now current living and rental in Ireland with bank statements amongst many other documents,

Yes the sensitive numbers were scratched out, but promises that these documents including others weren't published went unheeded...

    Hi Miller

I live in London and considering moving back . I am looking at building near my family home. How do they assess "returning emigrant' how long were you gone?? There doesn't seem to be any definition online .

Each county differs although as far as im aware they cant differentiate certain lengths of time away compared to the next applicant.

They will look for all UK records, then local records to show your actually living in the area etc..so like our child started in the local school, we rented near the site etc etc. Their main concern is its not a holiday home and they then stipulate you cant sell within seven years.

We had relatively hassle free journey through planning, three months start to finish. Though we had done our homework both in the application, the design and the Councils own rural design requirements.

So plan to be immersed in local life as you apply.

I think we got took by surprise how little time it took to achieve planning. But looking back our careful and thoughtful planning was most likely the source.

    Good luck...
