Hi everyone. I wondering has anyone come across this situation or have opinions on my on where I'm at.im recently married and we purchased a partialy constructed house (roofed Windows in and plastered on the outside) locally.it has been left in that condition for a number of years as it had been repossessed. My engineer done up a report for the solicitor and everything is in order ie.the house is fully compliant with the old regs planning given and is built where it should be.no problems there. However it appears there was no commencement notice sent in at the time(2005) and the development fee was also not paid. I went to our local planning office to pay the fee so we can proceed.the person I dealt with told me as the commencement notice wasn't sent in by the previous owner I would have to apply for retention which will bring me into the new planning regs. I really don't want to have to do this as it would put a lot of extra expense on the project(treatment plant as opposed to the Sr6 figure8 septic tank etc which is on the planning I have.I'm applying for a mortgage shortly an need everything in order also.any ideas greatly appreciated!!!

What has your solicitor advised? Asking for specific advice is against the charter so this will probably be closed. You might be better off looking at posting in accommodation and property.

    Mod:

OP, this is a request for legal advice. That's not allowed by the forum charter.

The wrong advice could cause significant expense.

    You need professional advice.

    Thread closed.

(EDIT: if you want, I can ask the mods of the Construction & Planning forum if your query can be transferred there. If so, you can let me know via PM, and I will see if it can be transferred.)
