Can Ex stop me?

    Hi,

    My soon to be ex husband and I have been seperated for oer 4 years.
    He went ahead and booked his time off from work (to spend with kids) and didn't discuss when, which is what we agreed. Trouble is, I have booked a holiday for the time he wants with the kids.
    Question is, can he stop me taking the kids away for a week to the UK?
    He can't afford to take them on a holiday, also it is my eldest's birthday and he had him for it last year. He is adamant he will have them for that week. I am adamant he will not.
    Can he stop me? And will any judge out there stop the kids having a nice holiday with me, when he has no intentions of bringing them himself?

    You think you're a better parent because you can afford to bring your kids on a holiday but their Father can't?

    How much would it come across as he said -she said if before a judge. As far as I know both parents need to consent to the kids leaving the state -but not sure how big a deal it'd be going to uk . Either way if you went and he kicked up a storm when you're away it could be wreck the holiday -
    Did you inform your ex that you were taking them on holidays on those dates -if not there's 2 of ye in it - any chance ye can work out some kind of compromise ?
    Also any chance ye can e-mail each other with dates and info about the kids- that way ye both have records of times and there'd be less "bickering" over who knew what when...

    Yes he can stop you. If I were you I'd go to your local dc and look for a summons for a hearing to take the children out of the jurisdiction.

    Have you a formal arrangement-access agreement in place already as to who has the children when? Who´s time would it have been with the children if neither of ye had planned anything?

    Could either of you change the week so they don't clash? Would be lovely for kids if you could compromise so they get best of both worlds and don't have to witness there mum and dad fighting over them
