Want to hire someone whose visa is expiring

    Hello,
    I want to give a full time position to someone who has been working with us on a freelance/sub-contracting basis for the past couple of months.

    This person's visa is about to expire in a few days. His option is to pay for an English course and renew his student visa and work with us part time, but this would eat in to his availability both in terms of available time and the fact that he can only work 20 hours as a student.

    I have been told by the department of Jobs and Enterprise that the position would need to be advertised for 21 days and the work permit applied for which can take 4-6 weeks, so this is obviously a much longer time frame than the few days we have before his visa expires.

    If he purchased the course now he would have his student visa renewed and over the next while he could apply for the work permit etc, but this means wasting the money on the course purchasing.

    I'm wondering if anyone has been through a similar process before, or knows enough about how this works to be able to advise the best course of action. We were hoping for example that he'd be able to pay a portion of the class fees now and schedule the classes for 1-2 months down the line.

    Any advice much appreciated.

    Hire somebody that doesn't need a visa

    You will need to demonstrate that there is no one in all of the EEA who is able to do the job. That's why it will take a while - and unless your worker has some very specific ethnic-related or in-demand skills, it's unlikely to be true.
