Garage damaged car

    As above, a well known garage damaged our car after we left it in for a very small job,which cost less than 200 euro.

    we drove away, and later the car broke down and had to be towed and sent to a main dealer.Bill is now over 2 grand, as the first job damaged the engine

    My question is, is there any way of finding out if they have been brought to court before for same type of thing, ie, damaging car.

    1. There may be a small chance. The relevant court lists could be gone through on courts.ie. This may show if these people have been involved in proceedings before. However, you are unlikely to be able to get District Court lists which is where car damage claims like this are likely to be.

    Ive been having a look , but I may be doing it wrong :)
    Im looking under the Judgements section, which seems to bring up High Court, Supreme Court an Court of Appeal. Cant find anything under District Court


    I understand what you mean, in that it may do me no good anyway, but I suppose I was clutching at straws.

    I think we may just have to go through the Small Claims court, as I cant afford legal expense's at this point.

    TBH other than the nuisance factor of the Small claims procedure working in your favour to get this done you're going to need at least some advice in the form of a proper mechanics reports and (I'm open to correction) him/her there on the day.

    I believe the jurisdiction of the SmCC is €2000 also.

    Thanks, that is certainly something for us to consider alright. As I said the original repair was under 200 euros, but it ended up over 2Grand.

    Thats without lost earnings. its a Taxi.

    The second garage who did corrective repairs will give us a report. They have so far said that ,
    1: the original garage put in wrong part
    2: this wrecked the engine
    3: The car was not fit to drive when we got it back from first garage originally

    We have lot to think about for sure. Just nervous that if we dont go down the SCC, we would end up with a large legal bill as well.

    If the original garage supplied and fitted the wrong part then it would likely be simple enough to prove with the report from another mechanic. Has the original garage refused to cover the new cost of repair or have the flat out refused it was their work that caused the trouble?

    They have offered the price of the part back, but they want the part back in return!!!
    We had to tell second garage to please keep the part for us.

    other than that, we can go sing as far as they are concerned :(

    If they have confirmed themselves that they fitted the wrong part then it should be easy for scc but the problem would be the amount limited to 2k. Time to speak to a solicitor at this stage. A letter from them might be enough to get them to stump up and they could advise you on your best course of action.

    the only issue you have here is that you never gave the origional garage a chance to put it right, that may go against you.

    it may indeed, but if someone screws up the first time with it, why on earth would I feel comfortable going back to them? As I said they told us the car was fixed and fit to drive. It wasn't. SO to me, that mans they didnt know their stuff

    But I take your point , a court may see it differently alright :)

    We are going to call around a few Solicitors offices tomorow and see what they can recomend

    It's possible that one of the first things that they'll recommend will be that you get a motor assessor's report on the damage, the cause of the damage and the cost of repair.

    We should be able to get all that off the garage, no problem ( think )
