Can I apply for planning twice in Kildare

    Hi folks,

    Just a hypetetical question here.

    What are the chances of being granted planning permission a second time in Kildare provided I have sold my house and met all conditions set out by kildare coco when my original planning was granted, eg residency clause etc.

    Say I wanted to down size my house and reduce my carbon footprint and build a smaller house closer to my kids school which will cut down on fuel cost and carbon emissions.

    I know a good few people who have built second houses but unsure if they applied under the same name or maybe used a sibling or some other family member.

    Would I still qualify as "local needs" if I applied to build in a different townland to where I'm from but still in kildare?

    Generally the answer is no.

    The council would view it as having already provided permission to satisfy your housing need.

    The timeframe between the two plannings may be the main point of interest. If its a short timeframe I would think you will have trouble but if it was 10 years plus you may have more luck.

    But I'm sure as circumstances change you should be allowd to decide to make your life a bit easier by moving close to schools etc. They put in a residency clause so you can't sell with in a certain period so surly after that has lapsed you should be ok to do what you want?

    Yes I agree. I don't see why you shouldn't be able to build again.

    So then should who you sell your house to also be restricted by local needs?

    If not its speculative development by proxy, which is the reason is not allowed.
