Rental tax

    can anyone please tell me ?? Tia :)

    I have been renting since 2012 it was a friendly informal agreement and I never asked before to claim back tax credits for rent , just doing a quick search and it seems to be able to claim back tax for rent I have to be renting since dec 2010 or before , is this correct ? So this means I can't claim back money now ?

    Correct. The rent tax credit is being phased out so will be gone for everyone soon.

    You are right. You cant claim anything.

    Thanks for your replies .. I was renting prior to 2012 but moved to a new property in 2012 so does this still mean I can't claim ? It's very confusing

    What I mean is ... It states Id renting on or before 7th December 2010 then it can be claimed so I can claim for the property I was at in 2010 but I can't claim for the property I am in now since 2012, is that correct ? I'm so sorry if I am confusing things further

    Thank you so much that clarifies it for me :) I couldn't get clarity on the revenue site do you mind me asking where you found this info ? As my husband surely won't believe me !!!

    Wrong. Read the legislation.

    "(1A)(a) This section shall not apply as respects rent paid on or after 8 December 2010.
    (b) Notwithstanding paragraph (a), this section shall continue to apply for the year of assessment 2010 and each subsequent year of assessment up to and including the year of assessment 2017 in respect of rent paid by a tenant who on 7 December 2010 is paying rent under a tenancy."

    Anyone who was a tenant on 7/12/10 is entitled to the credit up to 2017, in respect of rent paid under A tenancy.

    She says she STARTED renting in 2012.

    I was renting in 2010 but not at the property I'm at now , I moved here in 2012 .. I claimed for 2010 and previous years

    You should've said that earlier so!

    If you were renting ON 7/12/10, you can claim it.

    If you weren't renting ON 7/12/10, technically you're not entitled but you could contact your tax office and see if there's any scope for a flexible interpretation, since you were renting before and since...

    Sorry, I missed the post where you said you were renting on 7/12/10. If you were, that's it.

    It's not actually complicated, it's 2 questions:

    1. Were you renting on 7/12/10? If no, sorry you don't qualify; if yes, continue to question 2.

    2. Are you renting in the current year? If yes, you're entitled to the credit; if no, you're not.

    It will depend on your age and whether or not you are jointly assessed with your husband (and obviously that you have paid PAYE!). If you have been continuously renting since 2010 and have claimed the rent credit previously, would the credit not already be listed on your annual tax credit cert? Normally tax credits are rolled forward each year based on the previous year's credits.
