Goods from "Wish" seized by Customs

    Hi,

    I just had a single item (handbag value €20) bought from "Wish" seized by customs for being counterfit. They say it will be destroyed and that the Copyright owner etc.. may bring a claim against me.

    As I had no idea Wish were selling counterfit goods, what should I do - let them destroy it and hope they don't bring proceedings against me, or should I challenge it?

    (FYI have requested a refund from Wish anyone as the goods were delayed)

    If anyone has been in a similar situation perhaps they can advise?

    I dont think that the purchase of counterfeit goods is illegal only the supply. I assume that they are implying you are importing with the intent to supply although this would be difficult to prove if you only bought 20 quids worth. It would be interesting to query how they determined it was counterfeit again I assume it is because of the low value specified for the product rather than any specific test they have to verify it. Unless you have some spare time and an interest in the law then probably best just to walk away

    Surely it's the selling of counterfeit goods thats the issue? I'd challenge it. You should ask them to prove it's counterfeit!

    If you decide to let them destroy it, you should ask for proof it has been destroyed.

    The importation of counterfeit goods is illegal.

    OP you said you didn't know it was counterfeit, how much was the handbag elsewhere?

    Not all handbags are advertised under the same name and not everyone recognizes pictures of famous brands, so it would have been impossible for them to compare prices to the real thing. I've bought something counterfeit before but didn't realize it was until it had been delivered as there was no mention of brand in the description or pictures by the seller.

    It is highly unlikely that the copyright holders would take any action against you as it would be quite hard for them to prove you were aware that the item is counterfit and given the smaill value and amount you order it would cost them to much.

    Just hold onto your request for an refund and send an email to Wish informing them that the item was seize due to it being counterfit and that you were not made aware the item you ordered was counterfit. At least it will give you some back up in the very unlikely case that the copyright holder contacts you.
