Tenant giving notice - what period is required?

    Hi all,

    Just wondering what is the notice period required, by me as a tenant, to terminate a tenancy that has lasted 5 years 2 months.

    I've found, on the Citizens' Information website, the following notice periods:
    • Less than 6 months: 28 days
    • 6 months to 1 year: 35 days
    • 1 to 2 years: 42 days
    • 2 or more years: 56 days

    At the same time, it says (about part 4 tenancies) that "After 4 years of your tenancy has passed, a new tenancy starts. The same 4-year cycle can begin again, leading to a further Part 4 tenancy".

    So, for notice period purposes, which of the following applies?

    "2 or more years", because I've been in situ for over 5 years?
    Or "1 to 2 years", because I'm 1 year 2 months into the second 4-year cycle?

    Any help will be much appreciated.

    Notice periods don't reset. 56 days.

    This is assuming you don't have a lease in force at the moment.
