Supreme Court Appeal - Can't find the case

    I've searched around and can't find any information on the appeal from the HC to the SC in:
    Miley & Ors v Employment Appeals Tribunal judgment in HC May 18 2009.

    Concerned whether successful applicants in judicial review should be awarded costs?

    If anyone has come across the case or others on the issue any info would be great!

    Is it possible that the EAT withdrew the appeal?

    If you have access to the Irish Employment Law Journal their are articles appearing in May and August of 2010 on the issue of costs in JR actions against stautory tribunials. If your a student your library should have them.

    Thank you both for the replies. Do you think it is safe to assume the SC did not change the approach that successful applicants in judicial review against employment fora do not get their costs as there is no written judgment anywhere or update in the IELJ since the High Court judgment?

    Have not looked into in depth but a change in the law of that magnitude would certainly have made all the journals. But as they say assumption is the mother of all mistakes.

    Just to note that the on High Court records on Courts.ie for the case in question the following appears as the last activity:
    18/12/2009 Supreme Court (interim) Stay tax & exec costs.
    Make of that what you will.
    The High Court judgement is interesting and I will have to dig out the articles to have a read.
    Do you know what happened at the EAT hearing?
