No NCT -Solicitor needed?

    Hi

    Hopefully someone can help me out here

    My nct was out of date few months ago, pulled over and told to get it done in 10 days.

    I got it done but had not got the guards name or station so couldn't produce it in person to the specific guard, Ive now got a court summons and am waiting to meet up with the guard who pulled me over. I wonder can guard help me out if feeling generous.

    My main query is when i go to court do i need a solicitor for this case, ive never been to court and dont have a clue what it even entails, its early next week so don't know do i even have time to get myself in order.

    Any help is appreciated.

    Well first off you didn't need to show it to the Garda that stopped you. You could have gone to your local station and showed it there. Did the Garda not ask you where your local station was?
    After all the recent furore of Gardai "helping" people I doubt any Garda would help anyone out.
    Now to the court case, you're looking at 5 points and a fine. I think the fine can be up to €1000(not sure)

    Hi no you will not need one you may get a fine if the new law was not it if you can prove you got it done and within 10 days and had it booked when stopped may strick it out

    I wasnt asked what station i could produce, just took name etc... and sent on my way,realised few mins later and drove back but checkpoint was gone.


    Im wondering do i need a solicitor and if ,the best way to go about getting one for nature of my offense

    Ring a few local ones or if you have the time go to court a day or 2 before your case and approach a solicitor you like the look of. Personally I'd get a solicitor because s/he can explain stuff way better than a nervous person. Court moves fast and if you annoy the judge he could come down hard on you.

    It happened in august and i got it done about 12 days later, was ringing around for cancellations and ended up getting it done a lot further away than my local centres as i couldn't get a cancellation close to home.

    My trouble is ive work next few days and its a new job and feel id be taking the piss trying to get time off and the court date is the start of next week so dont know would i have sufficient time to organise a solicitor properly.

    Any idea how much planning or how easy it is to get on on such short notice?

    An hour is all you need. Do you have a local paper. For example in Kildare I'd get the Leinster Leader or Kildare Nationalist and look at the court cases for motoring offences. If I seen one solicitor representing a few people I'd probably go with him/her. Were not allowed recommend solicitors on boards so that's about as much as I can suggest.

    Where was it was it cork do u have any offence from before for any road traffic

    Ive no criminal record, never been to court,

    Ive been fined for parking and breaking speed limit but never any further than a fine.

    Turn up in court, take the fine . Take the points.

    If you had any interest in producing the evidence you could have made an effort by contacting any garda station for advice - you didn't so you'll just have to take your medicine and no solicitor will get you off on this count.

    There is absolutely no way of knowing that. For instance, if the summons is issued in the wrong jurisdiction it is likely to be dismissed for that reason. This sort of stuff happens all of the time.

    Fair point - never say never but from my own experience people are not getting off on technicalities as frequently as in the past.

    Get a letter saying u need clean licence for work prove you got it the new law wasnot out and bring in two hundred with you try and see gArda b4 court show him you had went and got it done like he asked show letter say in nedd clean licence ask him is there anyway that you can give money to charity he might strick it out
