parking fine prosecution pending

    Hi everyone. This is a bit of
    Messy situation. Basically my mother bought a car for my sister. It is registered to my mother. Sister got a parking fine and didn't pay it.
    I have just found the letter as mother has moved house. The last day to pay fine was Dec 29.when I went to pay it it said prosecution pending.
    Now what do I do from here.
    My mother doesn't drive so should my sister contact council and try and get her name summoned or try and pay

    You yourself should do nothing as it isn't your mess to fix :)

    Fines like this generally default to the car's registered owner. It's up to the car owner to advise the fine issuing body the details of whomever it was who was driving the car at the time otherwise they are responsible for paying it. As a matter of urgency, your Mum needs to contact the relevant council ASAP and see what they propose doing from here. The fact that she has moved house may buy her a day or two's grace to either pay the fine or to pass on your sisters details to them.

    Given that she and your sister have had a good 56 days to address this, you may find that they not be as obliging as they'd like them to be. However, if it means your mum avoids a mess of your sisters making then so be it.

    Thanks! Hopefully they will accept payment up front even if the original fine has increased

    You might find the council to be flexible about payment dates, the Garda less so.

    You may have to pay more than the fine at this point.

    Your mother must also ensure to update and return the car's registration documents with her change of address.

    Either that or transfer registration to your sister if she is the one who keeps and uses the car all the time (your mother can retain legal ownership or title if she wants). That way your sister is automatically responsible for her own offences.

    It won't help the current situation but it will prevent fines and other car related correspondence (tax, NCT) being sent to the old address in future.
