selling a house through the court

    Hello,

    my sister is currently trying to force the sale of her house, which was bought with her boyfriend at the time. an application has been put through to the courts but we have not heard anything in about 4 months. does anyone know how long this process takes or anything we can do to speed it up?

    Need more detail. How does one force the sale of a house?

    Is she suing for specific performance of a sale contract?

    If so, she could possibly lose and no sale might happen

    It is probably an application to the Circuit Court under the Partition Acts seeking a sale in lieu of partition. The length of time for such proceedings varies depending on the facts of the case and the court area, but typically these types of cases often take18-24 months or even longer to get on for hearing. Matters can be complicated if the case is contested by the other party, if there is arrears on the mortgage or if the property is in negative equity.

    Anyway, the simple thing to do is for your sister to ask her solicitor for an estimated time scale rather than rely on posters on an Internet forum who for the most part, despite their good intentions, haven't got a clue about this sort of thing.
