am i entitled t work holiday pay out of work?

    Have a question i need answering, i been out of work since april this year due to stress/anxiety from stress/bullying, i been surviving off illness benefit since. Im not going to get into all that stuff its a whole other story. My question is i didnt leave work and i wasnt let go, am i entitled to holiday pay for the days i didnt take? I have not gotten a penny since the last day i worked. (They give 20 days a year)

    Whats my legal rights and standing on this matter?

    I don't think you are until you are out on holidays.(you'd have to be back at work and then take holidays) Technically, you are out sick now. You are still employed so unless you are left go, leave or get fired you won't get it until then.

    I hope your bullying predicament gets resolved. It's an awful thing to go through. Box clever.

    Well its a whole other thread but the absence crom work is valid and is ongoing, Would i be entitled to bank holiday pay and public holidays (christmas day, st stephens day) etc?

    Just my own opinion.. I highly doubt it unless you have a specific contract with your employer outlining sick pay though I imagine that might have affected your illness benefit payment from the get go. Holiday pay is generally in lieu of days worked and you mentioned that you haven't worked since April so I don't see any entitlement really but I may well be wrong.

    No, you are not entitled to P.H. pay while you are out sick. Only women on maternity or adoptive leave have that entitlement. Look up the Organisation Of Working Time Act 1997.

    I don't think so. You're not working so you are not earning holidays. You're being paid by the social welfare for all the Bank holidays in your illness benefit.

    They don't 'give' you 20 days holidays you accrue them for every day worked. If you don't work you don't accrue these days.
