Folio issue

    Hi all,

    I am in the process of buying my grandmothers house, she passed away a year ago. Her house sits on a good bit of land, that was on 3 different folios. 2 of them were merged into one and it is registered in her name.

    The other is under a different folio number and registered to a man from 1959. Is it basically saying she didn't own all of the land in her back garden? I know she was sure she had bought it in the 70's. Any idea how do I go about solving this?

    Very difficult to say without seeing the relevant folios. Have you raised a query in the Property Registration Authority Office?

    Does the parcel of land have access to a road, and would it contain enough land for a house?

    My grandmother had a similar problem after my grandfather passed away. My cousin's husband is a solicitor who handled it for her by applying for squatters rights. You need to speak to a solicitor about your problem and maybe mention this to him/her.

    You need a competent engineer who carries out mapping/land surveying work on a regular basis. He will need original Land Registry folio maps. When he checks the boundaries to the property, he will be able to say where the boundaries to the property are located and which folios are affected.

    EDIT: if the property is located (wholly or partly) on a land registry folio owned by somebody else, you will need to take legal advice.
