overnight standby / subsistence rate

    Hi Guys,

    Not sure if this is in the correct place but if not perhaps the Mod's could let me know where it should be.

    Anyway on to question. We are looking at moving into a 24 hour 2 nights per week support phase as a trial for a few months. I believe that the guys would be entitled to a subsistence rate of 107.96 per night. They will be on call from 6 pm until 8 am next morning. But I am unsure as to where the cap is on this I.E. 1 tech per month will do 8 days of overnight cover. The normal rate of 107.96 can be claimed for 14 nights but is that per calendar month? or per annum and then switch on to the reduced rate for the next 14 nights and then after that period on to the reduced rate?

    Will they be staying at home, working unreasonable hours from an office or are you talking about people staying away at a hotel.

    It would be a mix really there will be occasion where they will have to be in the office overnight and from time to time I can see them being able to be at home. Don't think overnight in a hotel will come in to it tbh.

    It's hard to see how you could justify a subsistence rate on this basis - you might get approval for some sort of meals allowance bt the higher rate is intended to cover the costs which they would have to incur "wholly, exclusively and necessarily" in carrying out the duties of their employment. IWthout a doubt you should have to pay them more for out of hours work but it would have to be subject to PAYE.

    Thanks for reply. Is there a standard rate that should be paid on a standby rate? I.E. 5/8 of hour per hour on standby? That would then have to go through PAYE.
