Job refusing to give me P45

    Hi all,
    I was wondering if some of you could help me please. I have worked part time for the last 2 years and have recently enough turned 18. We had a change of ownership in July therefore I received my P45 and all holiday pay etc from that employer in July. I worked for the new people for the last 5 months and unfortunately I just couldn't stand it there any longer. I got a new job on the 21st of November 2014 therefore I handed in my notice on the 22nd of November. I wasn't on a contract as was nobody in the shop so I started my new job on the 27th of November. They were extremely impolite to me when I was leaving after they constantly had told me that I was one of the best workers they had. I still tried to part on good terms though.

    They paid me holiday pay and I got my last set of wages from them and they told me theyd give me my P45 the next week. The next week I went up to collect it and they said theyd have it the next week etc. This has been going on until last night, the 15th of December I went up and questioned them on why they wouldn't give me my P45. They told me that there accountant was away until the 22nd of December and then he would be on Christmas holidays. As you can imagine, I wasn't happy to hear this but I felt like something wasn't adding up with them so I rang the main guy who was never normally in the shop I worked in (He owns over 6 shops and He spends most of his time in them ones). He told me he would have it for me today the 16th and apologised for how long it was taking.

    Today they texted me saying they had it for me. I went up to collect it and thanked them for giving it to me. I went out to my car and looked over it with a friend. They had my date of birth wrong on it and they also didn't give me my proper P45, they gave me a proforma. This isn't accepted by the revenue. I went back in to them about it and they were extremely argumentative with me about it and tried to convince me that was my proper P45.

    I really need advice on what to do next because this isn't my P45 and I feel like they haven't been putting my tax through there systems. There foreign and they are very hard to deal with. Thanks in advance.

    Have a look at your payslips. Have tax and PRSI been deducted?

    Contact Revenue and ask for a P21 balancing statement. Might take some time, as it's the end of the financial year. But it will show whether you've paid tax or not. If it doesn't and your payslips show you have? Get on to Revenue at once. They will lean on your old employer to produce the tax paperwork.

    Whilst dealing with Revenue, tell them details of your new employer. Get their reference number and call that over to Revenue. They will then issue you with a new tax cert (Form 12A).
