victim compensation after serious assault

    hypothetically speaking if a person was the victim on an assault and sustained injuries that required very expensive medical treatment what is the process involved in making a compensation claim?

    should the victim wait until after the criminal case is over?
    is the specialist solicitors that deal with this sort of thing?
    can the evidence gathered by the gaurds be used to make the claim?
    if the accused in the assault didnt have money how would the victim pay for the treatment?

    There is a Criminal Injuries Compensation scheme which may provide compensation to cover out of pocket expenses to victims of crime (doesn't cover compensation for pain and suffering though). More info here:

    would it be better to claim via a solicitor first or go straight to that route??

    The victim should be aware of the time limit rather than waiting. If the info about the time limit is not on the link to the website then a phone call to the criminal injuries compo board may give the answer.

    I think that a report from Gardai will be needed to support a claim of this nature. I am not suggesting that anybody should wait for the report, considering the time limit.

    This is not an area of specialisation. It is too narrow an area and there is no realistic possibility of making a sufficient income from it. A civil litigation solicitor or criminal solicitor would be likely to be familiar with this stuff. Or a GP solicitor.

    If the victim didn't have the money to pay for treatment they could ask a solicitor about potential for a civil claim because these criminal injuries claims often take years. I suspect that this delay is due to lack of State funding.

    Apart from loans, Community Welfare Officer or charity, I'm not sure how treatment could be paid for before a payout from a civil claim or criminal injuries claim.
