    hi

just a quick query I was travelling up the N7 last night and noticed a Go-Safe Van parked up on a Garda Ramp.

I was under the impression that those ramps were only for use by the Garda or Military Police only :confused:.

    Am I wrong ?

    regards

    This.

    Check here: http://www.garda.ie/gosafe.htm

There is only a fairly limited section of the N7 in the GoSafe remit.

The N7 only exists from Naas to the Red Cow anyway doesn't it?

    hi

no it was definetly a Go-Safe van and it was inside the Go-safe area on the N7. Just thought it odd sitting up on the Garda ramp .

    regards

If it has a sign saying Garda Only then you may have a case. That said, GoSafe operate under the direction of the Gardai so it may not be cut and dry. I'd imagine someone operating under the direction of the Gardai, with suitable oversight, has similar powers in defined situations.

    Thee is no issue whatsoever.

GoSafe are operators of "Garda mobile safety cameras" and therefore they are in effect garda vehicles.

A Garda vehicle has no special powers under law(other than livery), only the Gardai operating it.

Whilst they operate under the direction of the Gardai, the equipment is owned by the IOM Consortium and is most certainly not a Garda Vehicle

Can you explain how it is nit a "garda" vehicle.

being a "garda vehicle" does not have to mean it is owned and operated by a garda.

Basically the raised areas can not be used to have a picnic. It is for garda or lets put it simpler "garda approved" vehicles.

Why is this relevant? It doesn't really matter what the sign says if the van equipment believes you're speeding. If the Gardai are unhappy at the vans location (and I'd like to see anyone come up with a plausible reason why they would be), they have legal ways to deal with it.

What legislation are you basing this off?

It sounds suspiciously like an opinion based on nothing but supposition and stated as 'fact'.

GoSafe vans are private. GoSafe vans are not operated by Gardai. 'Garda approved' is not a thing.

Where else could a GoSafe van be stopped on a motorway?

IMO, they shouldn't be anywhere near a motorway.

When joe public spots one on a motorway, he hits the brakes, no matter the speed he's actually doing.

The only people who should be involved in enforcing speed on motorways are Gardai, who will actually think about where they set up based on road and traffic conditions, as opposed to pat in the GoSafe van who doesn't really care once he hits his quota.

    The N7 isn't a motorway

I'm basing it on something called common sense.

Can you show me the legislation that says only Garda vehicles owned and operated by an garda siochana are the only vehicles that can use those ramps.

No you can't cos it does not exist.

Its a raised area that is not for use by the public as a stopping area. - there is no legislation hat only a garda car can use it. There would be zero chance of challenging a gosafe van using the raised area for speed detection.

    That's called common sense too.

The bit after Naas is though and I spotted one there on the inbound stretch between exit 10 and 9 (when it becomes the N7) about an hour ago. Not the first time I've seen one there either - "safety" indeed!

What does does common sense have to do with legislation?

S.I. No. 182/1997 33. specifies when and only when a vehicle can park on a motorway.

Even were the ramps not considered part of the motorway, Roads Act 1993 55. states who and what can use for access (not park) land along alongside a motorway.

I do look forward to your apology.

    Anyway. ...
THERE ARE NO GOSAFE LOCATIONS ON A MOTORWAY

Dual carriageway, High Quality dual carriageway. Are not motorways.

I thought this, then I realised there is a very small section of the M7 that is within the GoSafe remit. I believe its the only section. Open to correction.
