I have a house built in the 1860's and a neighbours foul and surface water drains into old pipes that go through my garden and are my private drains/ sewers . Can I cut off these pipes and get the neighbour to find an alternative route ? As far as I know from looking at the old deeds they have no right of way or way leave

If in excess of 20 years they do have a (legal) right of way (whatever is says or does not say in your title deeds).

Most probably shared drains and not as you belive them to "your private drains". Unlikely that you can interfere with them and not face consequences arising out of Section 70 of the Water Services Act 2007.
