Neighbours new fence

    Sorry if this post is in the wrong area, just made sense to me to post here.

    So any way long story short.....I come home today to find my neighbour has erected a brand new 8 foot tall fence albeit on their side of the wall ( dividing wall used to support fence panels ). Now my issues are as follows I live in a mid terrace, i get the sun (what little we do get) on the back in the morning, but as the day goes on I feel I will be in shadow caused by the fence. It was my understanding that anything taller than 6/6.5 feet they needed to at the very least run it by myself and my wife or have permission, I know their may be some loopholes as in its not a permanent fixture and such, but i had come across something about a " right to light " in essence they can't obstruct light to any windows ( unless its a natural feature ie: tree, rocks).

    just some backround on the house itself, the owner recently died, her son had been living with her, it seems to me that the family are putting some money into the house in order to sell it, if this is the case I now any sort of legal issue would be dragged on till it wasn't their problem anymore

    Column 1

    Description of Development

    CLASS 5

    The construction, erection or alteration, within or bounding the curtilage of a house, of a gate, gateway, railing or wooden fence or a wall of brick, stone, blocks with decorative finish, other concrete blocks or mass concrete.


    Columns 2

    Conditions and Limitations

    1. The height of any such structure shall not exceed 2 metres or, in the case of a wall or fence within or bounding any garden or other space in front of a house, 1.2 metres.
    2. Every wall other than a dry or natural stone wall bounding any garden or other space shall be capped and the face of any wall of concrete or concrete block (other than blocks with decorative finish) which will be visible from any road, path or public area, including public open space, shall be rendered or plastered.
    3. No such structure shall be a metal palisade or other security fence.

    Thank you, I had a feeling the height has an issue, but better to have the actual statute to hand when I talk to them.

    If you think the family are going to sell the house then the strategy I'd approach would be to politely inform them that any prospective buyer will probably be advised by their surveyor that the fence is too high and that that they (the family selling the house) will probably end up being forced to reduce the height in order to complete the sale.

    That way you transfer the problem back to them instead of you looking like a difficult neighbour.
