Building Regulations - What Building Regs apply when?

    What "Building Regulations" apply to a new building if the Regulations change during the design / construction process?

    Do the current building regulations apply from when the:
    - Planning Permission is issued, OR
    - Commencement Notice is submitted, OR
    - When the Completion Cert is issued?

    To avoid confusion, this query is not referring to the Building Control Regulations.

    The short answer is 'it depends'. Each of the TGDs has a note at the start explaining the effective dates. Generally these relate to the date that a building or works commences on site, but in some cases, transitional arrangements may apply. If there is a specific area you are concerned about, check the relevant TGD (or check all of them) to see which arrangements apply.

    Each part of the building regulations has it's own technical guidance document and each document has it's transtitional arrangment stated. The relevant dates are always - the planning appliaction date and the substantial completion date meaning the date upon which the external walls are completed.

    Having had reason to go through most of the TGD and legislation over the years it was always the date of grant of planning that was used. The Building Control regulations were the first (open to correction but believe I am correct) to use commencement date as a starting point for a piece of legislation.

    All of the current TGD's (A-M) refer to the document in general applying to buildings or works or material change of use commencing on or after a certain date - no mention of grant of planning.

    Planning only comes into effect in the tranistional arrangements for each TGD, for example where 'planning was granted before x date and substantial works were completed by y date'

    Open to being corrected as always.

    Commence date trumps planning date. We have grants from 2011 starting and they must comply with current TGD.

    compliance also refers to regulations in force at time of completion

    The 2014 Part E regs will apply to building starting on or after 1st July this year - irrespective as to when planning was applied for.

    New houses must be tested for sound.

    Yes, I have advised that in the forum before. The Technical Guidance Document has actually been produced now and is on the DOE website instead of an S.I.

    also, the new Part K regulations are in force since the 1st January 2015.
