package opened and empty

    Hi folks.
    i bought something online last week and paid via paypal.
    It arrived today in the post but the envelope was ripped and resealed by 3 An Post stickers. The packaging for the item was inside but the product was missing.
    Ive sent pics of everything to the seller but no response yet but ill give him till tomorrow to respond before i do anything.

    My question is, where do i stand on this? I cant imagine An Post would have accepted a package with one half of the enveloped open and then resealed it themselves so i assume it was intact when posted.
    If the seller kicks up a fuss is it upto me to contact An Post or is it the sellers responsibility? I dont want to jump in and open a paypal dispute as it looks like the seller has done nothing wrong but i havent recieved my item.

    Did you have it sent insured? If so then there shouldn't be any problems. If not and the seller can prove that they sent it packaged reasonably well then you are going to have to use some sort of arbitration to resolve it.

    Dont know if it was insured. I was just told it would be €3 for shipping. It was sent in an An Post envelope with no stamp, just a green sign on the corner saying "An Post postage paid"

    If it was only €3 then I would say it wasn't. Without purchasing insurance then the seller is within their rights to not offer you anything. Hopefully you'll find they are a little more generous than that and will at least offer you something!

    Thats not the answer i wanted lol.

    Ive just gone thru the messages sent between us and took screenshots. He told me that postage was going to be €3 registered.
    Does that change things for me? He said it would be registered but sent it ordinary post.

    Claim with paypal.

    You have no contract with An Post so it's not you to deal with them - it's seller's thing.

    Did you check with An Post as to why it was opened?

    I rang my local post office and they said it could have fallen out and might have been found later and waiting for someone to claim it. I need to send off a form with details.
    That doesnt seem likely to me tho as the outer packaging was still in the envelope. Strange one.

    Best to just get in touch with Paypal and put in a claim and let them decide.

    If they have sent it registered with An Post it will be covered but they would have had to subsidise the cost themselves even a standard envelope registered is €6.

    He just got in contact and said he will send another one tomorrow and register it. He said its not the first time its happened when sent in an envelope. Makes me think why send it like that so!!
    To be fair to him he didnt argue or complain so he seems a nice guy. I was worrying about nothing.

    Fair play! Nice for it to be resolved so quickly! Sounds like they are probably making a tasty margin of it though!

    It was only €30 but next cheapest was £30 from the uk. I suppose if you buy enough to keep costs down and sell a little cheaper than others then youll move more.

    Same happened to me, registered post but no item delivered. I filled out a form with An Post and they paid the value no problem.

    anything bought on ebay and paid with paypal is covered under buyer protection, if its not delivered or empty box arrives then you can open a dispute and get a full refund
    its up to the seller to prove delivery, ie tracking number ect
    this is the reason many sellers are not using ebay anymore, no protection for the seller, ebay always favor the buyer

    Thanks for anyone who replied.
    My new package never arrived and i got back onto the seller who was waiting on a delivery. I wasnt bothered as it was a christmas present. He then said he was about to dispatch it a few times and it still didnt arrive. Kept fobbing me off. Checked paypal last week and i had 45 days to make a claim and it was day 41.
    Back onto the seller and he was saying he was waiting on a 2015 version and would send it in a few days. I told him if it didnt arrive at my door by last wednesday, paypal day 44, id be processing a claim for a refund. No probs he said and quickly sent one out and i had it wednesday.
    Alls well that ends well. Its now wrapped and under the tree.
