Parking fine summons help

    This may be a long shot but I was accused of parking without a disc outside my place of residents ( didn't have all the right documentation to have permit yet).

    On Feb 13th of this year.
    Due to the fact I moved out for a number roof months I now have a correspondence for a summons to court 18th December 2014.

    1) First off as stated here:

    It must be issued within 6 months of the accusation, does that mean technically i could argue this. I have my final year examination on the same date and so would not be able to attend but besides the point.

    2) If I prove I am and have been a resident of the the street where I got the fine and present a parking permit now that I have one, do you think I could get off with the fine?

    I'd say you are being summonsed for not paying the fine which is a seperate (and more serious ) offence to parking with no disc

    Thanks for the reply, no the summons details that is in regards to the offence not the non payment but essentially they are the same thing.
    Unfortunately due to me not living in the house for a number of months, I did not receive any correspondence reading the offence, only the most recent about the summons. :/

    It's probably worth having a chat with your solicitor about this. They can advise you on the best course of action.

    If you have a summons you must appear in court, or have a solicitor appear on your behalf. Don't ignore it - your best bet is to seek legal advice. As to (1) the 6 month limit is for the application for the summons, not the actual service or court date.

    I'm pretty sure you wouldn't get summonsed for a parking offence.

    That's what I said earlier and the guy insisted it as a summons for parking , not for not paying the fine.

    As long as the application date on the summons is within six months it's not outside the statue of limitations.

    What is the offence (act and section) on the summons and who is prosecuting you? Non display of a permit is not something the gardai deal with and it normally results in a clamp as opposed to a summons.

    If you can't go and don't have a valid excuse, my advice would be just don't go - you will be fined about €80 which is less than what a solicitor would cost to represent you and even with a solicitor, there's no guarantee that he/she will get you off completely so you could end up with a reduced fine (say the parking ticket fine of €40) and a hefty bill (€120-150) from the solicitor.

    Hi. I have a summons for parking a vehicle without a parking disc. The date for appearance is tomorrow. I know I have left it very late but I completely forgot about it. Anyway my problem is I cant make it as I simply cant get off work. My question is is if I dont show up will it just be a standard fine I need to pay? CoyleMJ you seem to think it is. If it was I would be happy with that,,, Thanks in advance.
