Hi there, was wondering if anyone in here could help me. I was left a small number of cattle in my fathers will and the time has come for one of the calves to be sold. I'm just wondering can I go ahead and sell the calf or do I have to do something like get a herd num myself before I do so?

Your fathers herd number will still be active. Do you plan to farm yourself? If so use this form to change the name to yours-

    https://www.agriculture.gov.ie/media/migration/animalhealthwelfare/registrationofpremisesanimals/ER12800513.doc

Also has the animal been tested in the last 12 months?

You'll need to notify the mart of the name change so the cheque will be correct. They could prob send it to 'Reps of the late Mr XXX' or something similar.

if you sell him at the moment the mart will make out cheque to your father's name and you wont be able to cash it until herdnumber is in your name and mart can reissue cheque in your name.

get onto your district veterinary office and get herdnumber into your name asap, easiest way

As far as I know this is not possible until Probate is complete.

The animal has been tested yes. So do I have to go through the process of getting a herd num myself or is there any way of selling the calf quickly. I plan to keep the other cattle I have and my father has also left me his single farm payment so I have to get a herd num anyway so I can receive the payments and keep the cattle. Really sorry for the questions as I'm sorta new to all this!

you/or the executor of the estate can sell the animal, the cheque then becomes part of your late fathers assets that can be divided as his will asks

    Sorry for your loss.

I don't know the in's and out's but would a private sale be possible.

Thanks so much, it's awfully strange not having him around, he's a big miss :( I suppose I could get the word out about him being for sale, never even thought of doing that. Would it be just as straight forward as me selling him to the buyer and we both go our separate ways, do I hand over the calves card? Again really sorry for the questions!

I can't tell you the legal niceties of doing so but yes you hand over the card and fill in a movement notification to officially move the calf from your herd number to his. I just thought it would avoid the cheque being out in your fathers name issue.

I'd ring the mart where u plan to sell the calf, and explain ur case, if they issue the payment to u directly to it would be the best option, and the best way of securing the marke value of ur calf, instead of inviting a cattle dealer into ur yard.

Aye i might just ring the mart to see if i can do it that way. I rang the Dept of Agri there and they said i could sell away at a mart but the money would go straight to my father's estate. I,d eventually get the money but i could be waiting up to next year to get it.

Incorrect, you can transfer herd number into your name prior to completion of probate. Did it myself this year. Similar situation.

When my Uncle died I became the "herdkeeper". Any payments SFP etc were paid into the executor account until probate was completed.
Dept then issued me with a new herd number.
