Parking Fine

    Hi all, I received a parking fine some months ago, and I had the pay & display on the dash, but didn't see the notice under the wiper until the next day at which point I'd also received one for non displayal of tax. (This is hard to beleive, but 100% true!)
    I got hold of the parking attendant and he apologised for the tax fine as it was clearly taxed, but then explained to me that the parking fine was from the previous day.
    I e-mailed the head office with photos of the tax disc and the P&display & fine notices.
    Cut a long story short they quashed the tax one but are fully demanding payment for the parking fine, obviously now citing that I didn't display it, I know I did as it was still on the dashboard the following day!!
    In court later this month and was wondering what to expect????!!

    Will come down to a conflict of evidence between you and the attendant. Obviously you paid, but did you display? He willl say no you did not, which is why he issued the ticket. You will say yes, you did. And I think there are two arguments in your favour. First, is it likely that you would pay money and not bother to put the ticket on the dash? Far more likely, surely, that you put it on the dash but he failed to see it. And, secondly, the same attendant issued you with a ticket non-display of tax disc despite that fact that, as is now conceded, you were displaying a tax disc. So we know he's capable of failing to spot things that are displayed.

    In the end, it comes down to whose evidence the judge believes. But he can only confict you if he finds that the attendants evidence satisfies him beyond all reasonable doubt. And I would have thought that the two points above must be enough to create a reasonable doubt over the attendant's evidence.

    I thought as much, when I have seen the attendant booking people sure I've seen him taking photos, I'd love to see any photos he might have of mine as I know exactly where on the dash it was.

    To be honest I'm flabbergasted that they are continuing it to court, wasting the States time and money when I've made it obvious I have paid, I find it truly amazing.
