I know I am going to get a lot of haste over this but here goes.
I have recently started a job. In the interview I was told a lot of things that are not entirely true. In addition the actual day to day of this job is nothing like I imagined. Simply put I hate this job, it is making me utterly miserable and even the thoughts of going back in make me break out in cold sweats and make me sick to my stomach.

I want to leave the job but I know I wont get JS for a while if I leave voluntarily. How long is it likely to take to get JS? Trust me the last thing I want to do is go on JS but this job is literally killing me with stress.
My partner is also on JS, could she claim me as a dependent?

You may be disqualified from getting Jobseeker's Allowance for 9 weeks if you:
    • Left work voluntarily and without just cause

Perhaps you could give it (the job) some time and see can you settle in.

Could you not get sacked if you wanted to ?

I have no 'proper' just cause and I know for a fact I won't settle in because basically it is the worst job I have done in my life. I have learned an important lesson that this is not the branch of my career path I want to follow but I don't think that will go far with the JS decider. The only thing I can say is that I have a medical condition that means I need access to a toilet urgently sometimes and I have discovered that this is not always a possibility to access one. I don't know how much this will affect the opinion of the deciding officer though.

The only way of getting sacked from the place is not do your work/show up or commit a crime (steal or be abusive/violent) none of which are really a good option.

I'd try and hang on. Get your CV together and start looking for another role NOW. It's easier to get work when you're in work than it is when you're not.

Like the others say, your JSA/JSB depending on the contributions made will be discounted for the first nine weeks. So it's not the best position to be in.

I think leaving a job over stress and unhappy is a just cause to leave and receive benefits. Perhaps contact your GP and discuss situation with them that they vouch you were advised to leave on mental health grounds

I appreciate that and have already been looking for another job but, without wanting to sound melodramatic, this job is having a real, negative effect on my emotional and mental well being to the point of making me depressed, stressed, disrupting my sleep, appetite. I have lost half a stone in the last two weeks. I would rather walk into a job in a supermarket again than do one more day of this job.

I'd be careful there, one of the conditions for jobseekers States you have to be fit and able for work. If you present a letter saying you left a job on health grounds you could be disallowed altogether.

Imo your best option is to state your case to the DO like you've done here. You can be disallowed for up to 9 weeks but it is discretionary, and speaking as a former DO, I wouldn't be exercising the option myself in a case like this.

Ok, also a very good point. So you believe the best option is to just go in and ask for a meeting with the DO and explain my position and reasons for my decision as I have here. Or just go in and ask for the forms to apply for jobseekers and allow them to call me for a meeting?

Make your claim in the usual way, when you are in with the DO just explain that the job was causing you undue stress etc. like I say, this kind of thing happens to people and its normal not to overly penalise clients. Even if you were to be disallowed 1-9 weeksI'd say your chances of winning would be very strong.

Thank you very much, you have taken a load off my mind. This is a very hard decision but it is one I have to make. I really appreciate your help.
