Why a delay in handing over deeds to a house ?

    Hi
    I am currently sale agreed on a home,there is a big delay,the sellers solicitor requested the deeds from the bank about 7 weeks ago and still hasn't got them.
    the owner of the house is sick and his son is the legal seller now.
    is this normal to take so long ?
    the estate agent and the sellers solicitor both told me that they are 100% selling me the house and its just the banks delay because the son is selling the house.
    Anybody else gone through this ?

    Seven weeks is a long time. It would be fair enough to ask for an explanation at this stage. Perhaps your solicitor could enquire of the vendor's solicitor as to why this delay has occurred.

    Even if he is sick, if the owner of the property is alive and not mentally incapable, I'm not sure how his son is the legal seller. Even if the owner appointed his son as attorney to sell the property under a power of attorney, he would still be the seller, as opposed to his son.

    Thanks for the reply.
    The dad had a stroke,I'm not sure what way he is now,I just know from talking to his solicitor and the estate agent that the son is the one sorting everything out ( not sure what the re technical name is )

    They just said the banks are taking longer to go through everything because of the situation,that's why I'm asking does anybody know from a banks point of view how much longer should it take.

    Surly if it couldn't be sold they would have no reason to tell me otherwise

    Danske bank are particularly slow. As you have to write to pepper in shannon Co. clare to get the authorisation form and accountable trust receipt which you send to belfast so they tell dublin to send you the deeds.

    I have seen delays of several weeks in this process.

    Rest of the banks are two weeks or so

    this house is in Dublin and was rented out,the owner didn't live there,the house has been empty the last few months.
    I know that for sure because my uncle lives around the corner.
    The bank is perminant tsb.
    His solicitor said After his first request the banks sent him back forms to fill out wanting to know more details about the sale
    How much was everybody's fee etc
    He said a lot of banks are taking more time and going through things more than before.
    Because I'm a first time buyer Its hard to know who to believe,they will all blame each other for delays

    If the bank was asking about people's fees, then it sounds like a negative equity sale, where the bank isn't going to get all of its money back. Generally, the bank's consent is required here, as set out in the mortgage. Banks can be slow to give consent to these sales, and they like to pin down and agree the exact expenses and costs, to include solicitors' and auctioneers' fees.

    Could take a while. Hard to know how long. The seller's solicitor will have to chase them.

    He did say the bank wanted to know everybody's fee
    I'm probably been last to find out everything incase I back out
    I just wish they could just say it the way it is

    Turns out the Deeds were lost and they found them in the law society in town,has anybody ever come across this or know how long it takes to get deeds from there ?
