paypal gift payment-dispute over bank to charge back ?

    Topic might be a bit misleading,but heres the situation,ive purchased from person an item over facebook,and funds were sent as gift,to avoid any more charges,thing is that bothers me,we agreed before sale that person will include tracking since parcel is coming from uk.Now in the past i had no troubles and had few buys of him.But this time person failed to ship it with tracking,due to mistake he says happened in the post office,since he sends a lot at one go. Now i know there is a section of PP that says money sent as gift cant be disputed. So just want to know,if sender fails to deliver,can i contact bank to start dispute for charge-back to my visa debit,since ive used money directly from my bank acc. Reason im worried before i always paid in gift and got tracking no issues,and never went amounts over 50e to be safe,this time item was close to 100e,and i rolled dice for opportunity to buy fast.any input on issue is welcome,just need to know that if it turns out dud i might have some sort comeback.thank you

    No. PayPal have their own disputes dept. bound by the t&cs of PayPal also-which probably state unable to dispute gift payments

    Yes i stated that i know that they dont deal with gift payments,and know that they have their own department.
    My point was bypassing pp in general and going straight to bank to do charge back-only reason i think that would be trouble on what grounds would the charge back claim would be placed ?
    As in theory bank should be able to contact other bank to solve it,since pp is only middle man.correct me if wrong.

    But you dont have any grounds do a charge back. Your bank made a payment to paypal who then made a payment to the receiving bank. Your bank and the receiving bank have no connection. If you do somehow manage to convince your bank to do a chargeback Paypal will be out of pocket and they take that very seriously. At the very least expect Paypal to ban you.

    The bank are the middleman in PP transactions.
    The reason for my post (I did read what you said initially) was to highlight the fact that the disputes for your bank would have no chargeback rights.

    No hope in getting a chargeback and a bad idea to try it on paypal. Don't do gift payments unless it is a gift payment. Just send the extra to cover the paypal fees the seller wants to avoid.

    You will have to explain that to me. If i pay somebody via paypal then paypal takes the money from my account and transfer it to the receivers account minus their commission. What bank is the middle man?

    And I'd take my business elsewhere in future after that. No consumer loyalty from that geezer.

    Not quite on topic but I think it's relevant here.

    You can send as a payment without incurring fees if you have the amount in credit on your paypal account in advance. Which you can do by transferring from your bank account in advance. It's much safer than sending as a gift as you can dispute the transaction afterwards if needed.

    you're confusing not telling the OP what he wants to hear with being negative on them. (can you be negative ON somebody?)

    don't see any negativity so far everyone replied with their own thoughts.Since ive said the whole reason was that person didnt give me track number,he did say he had receipt for sending it thou,but its irrelevant since transfer was made by gift.
    Only reason i asked about bank thats because ive read on older threads online that most people that got into such troubles would get help from their banks thats 2y old topics thou.

    so far had only god experiences with pp,but usually with invoices as guarantee.

    So far knowing banking system i think theres little help,as had once double charge incurred on my account due to some online system failure,and only response from bank i got was to wait it out and see if other party will fix it,pretty useless job on their side,even managing such minor mistakes :/

    as for now nothing is lost yet,just wanted to know would i have any backup if delivery does fail,as its only couple days so far.
