Illegal and unlawful are different words...

    To break down the door of a house and take up occupation is illegal (on a number of grounds). To fail to deliver up vacant possession at the termination of a lease is unlawful.

    Do they not mean the same thing? Unlawful carnal knowledge is proscribed behaviour, illegal immigrants are those without a legal permission to be in the state.
