    Hi,

    I am just wondering if anyone can help with this. I signed a contract for a part time job about 5 weeks ago. I have ended up working about 40 hours a week since then. The workload and pressure is horrific for a minimum wage job (not to be dramatic).

    It states in my contract that I must give 2 weeks notice if I want to quit. However the employer only has to give one weeks notice or can fire me immediately as I am on a 6 month probationary period.

    My question is do I have to give 2 weeks notice to quit when I have only worked 5 weeks and am on probation? Am I contractually obliged? Because I literally want to leave soon as. I know by law the minimum statutory notice period is nil for under 13 weeks work. It just seems unfair that the employer can fire me on in an instant and I must give 2 weeks?

    Any help is appreciated, I am handing in my notice in 2 hours and I want to know soon as if I am stuck there 2 more weeks.

    The contract overrides the minimum statutory notice period.

    I don't think you can give one weeks notice as your contract, which you agreed to when you signed it btw, says you must give two weeks.

    Maybe someone can correct me if I'm wrong.

    You need to consider the consequences of breaking your contract - and also the fact that the employer is already clearly breaking it be asking you to work for more hours than you signed up for.

    Is it a small town, where the manager might bad-mouth you so you never get another job?
    Or does the manager or someone from the job know you outside work and have the ability to mess with you in some other way?
    Could they mess you around with your final paycheque, ie do you get paid monthly?

    Personally for a minimum wager, given what you described, I would just walk on payday unless there was some other factor keeping you there.

    (Assuming that you don't need to sign on, of course,)

    Be happy you're not in Germany, its a 3 month notice period...
