Court Summons? Talking on the phone

    Hi Folks... I was wondering would you be able to help me. I was recently pulled in by a Guard for talking on my mobile phone in the Dundrum area of Dublin and was told by him that I would be going to court and will get 6 penalty points with fine of €1,000 but that he was going to do me for dangerous driving?? He was in a under cover detectives car by himself, he got out and told me all this. Took my name, address and registration but never looked at my licence? He wrote my details on the back of a folder? Just a bit confused and kinda bricking it... 6 penalty points would almost certainly get me fired. Any information or advice would be great? thanks

    as soon as you get a fine, pay it ASAP and all should be ok, otherwise it was just a scare.

    Gets onto high horse, don't use your phone while driving, gets off high horse.

    If you do get summonsed you need to get a solicitor to fight your case in court.

    Thanks, its a mandatory court appearance so is the 6 penalty point mandatory as well? I know Del, I actually have hands free but I was on my old crappy phone and wouldnt sync to it. Ironically enough it was Vodafone insurance that was on the phone to me about my phone when I got pulled.

    Be glad you didn't kill an innocent bystander while on the phone, pay the fine and don't do it again. I call trafficwatch and report everybody I see holding their phones to their ears, just so you know...

    I know, I am usually on my handsfree but I use my old phone and it would not sync to the system. Lesson learned!! Just not sure what the story is with the penalty points

    Are you absolutely sure this was a guard?

    6 points - I can't figure that one out. It's 5 points if convicted and 3 for a fixed penalty for holding the phone.

    The €1000 fine I assume is from the regulations(1) which recently came in in relation to data access on mobile devices while driving.

    Perhaps he referring to something to do with dangerous driving?

    I'll resist the urge to admonish you.

    Yep in a pair jeans and top!! He was about 50 + He was in a undercover car tho. No id shown at all. Just the full lights flashing?

    I believe you mean unmarked - yes that would give it away alright.

    Wait for the summons and consult a solicitor when/if it arrives. If a fixed penalty notice arrives in its stead, pay promptly.
