    Hi Guys don't know if I'm posting this in the right place or not apologies if I have. So here it goes, Currently I am participating in The Leader Partnership Scheme, I am 6 months into a 12 contract. The Leader Partnership for my area advertised a position for a Supervisor at the end of July, I have close to 20 years experience in supervisory and Foreman positions, I have 3rd level standard of education.

    I applied for the position and was not successful, I wasn't called for interview. I have no issue with that at all. Since then I have taken up part time work as well as continuing with the scheme.

    The issue for me with this is that on the advertisement for the position it clearly stated that people who are unemployed for 12 months or more would only be considered for the position. Today 13/10/14 we were all introduced to the new supervisor, our current supervisor made the introduction he continued to tell us that the new supervisor had been working within the Leader in an administration capacity for the last 4 years, the new supervisor has no previous supervisory experience.

    The issue here is that the advertisement stated that only un-employed people would be considered for the position, My question is, is there legislation in place that prohibits this?

    Are the Leader Partnerships allowed to behave in this manner especially as they advertised that they are equal opportunities Employer?

    Any advice would be much appreciated.

    In my experience Leader groups /Partnerships have absolutely no accountability either in relation to employment regulation or financial matters. This was the reason behind moving governance to LA away from what in effect are self interested organisations which are supposedly self policing. There have been issues with the management of such groups. Considering that the average funding from the taxpayer / EU runs to millions of euro per year for each Leader group there is a very strong reason for reigning in these groups and having real accountability. As far as I can see your only remit in your circumstance atm is the EAT or labour court - not an easy solution for an individual against vested interests by any means.

    Cheers for the response, there was another lad on the scheme he finished up a few months ago he took them to the LRC made no difference at all in all serious we on the scheme are treated like crap and if we complain about it we are we can leave and have our DSP payment cut or stopped altogether, and if a complaint is made the amount of hassle one gets is unreal nothing short of bullying and intimidation. I feel that I need to do something raise the issue with the appropriate authority before something serious happens e.g last May one of the guys got an electric shock, we were told beforehand that the wiring and electrics were safe, NOT AT ALL, that was 5 months ago and still they wont provide any sort of P.P.E, I was asked in March when I started what size boot i take, I'm still waiting for the boots nevermind the gloves, glasses, hard hat, hi vis vest.

    Contact the health and safety authority regarding your PPE.

    Thanks for replying, I was onto the HSA this morning they took all the details, But mainly wanted the contact details of the Supervisor. He rang at lunchtime, and said that I would be moved to a new project from next Monday which is strange currently I'm 30 minutes walk from site but now they want to put me on a project that is 15 miles away, I dont have transport or access to transport he said that I would have to arrange my own way to and from work. The way I see it is that they're going to try and use this as an excuse to sack me.

    I think in a legal context for them to do that would only make matters worse for themselves.

    OP I'm afraid I can't comment on the substantive part of your posts as I simply have no experience in the subject. However an area I have some significant experience is 'managing people out'. I suggest you engage the services of an employment solicitor at your earliest opportunity, if this is not an option financially (or if you need a recommendation) contact your local FLAC.

    No one will ever know you've engaged the solicitor unless that become strategically advantageous but you will have the correct information to hand. The very best of luck with it OP.

    My only thoughts on your substantive question is it's not one of the grounds of discrimination.

    cheers for the advice MA, I have been in contact with a Solicitor (not about this matter but I will raise the issue with him) I suppose this is where it gets awkward and complicated, bare with me, back in May The Leader sent me to a local sporting club to do some dry lining, in the changing rooms when the old ceiling was pulled down (major leaks in the roof as well I've worked in construction all my life) the electrics/wiring were in a ridiculous state I made my supervisor at the time aware of the dangerous condition of the electrics, I was told to "fire ahead and see what ya can do" at that stage I said no that it was too dangerous, the guy from the sporting club who was liaising between the Leader and the club said to me when i made him aware of how dangerous the electrics were, he said to me and witness that " there is no way that the club would pay an electrician €300/400 to make it safe I then said that there is no way that I'm going back working there until it is safe, he argued with me about it, to make a loner story short both my supervisor and myself were told that they got a sparks in and everything sorted.
    Now they never got a sparks in he done some of the work himself, we were led to believe that it was safe so we went back working there second day in, what the guy actually done was pushed a bunch of live wires on the top of the wall when i was putting in the new ceiling joists one of the wires fell hitting me on the hand and throwing me of the scaffolding. I've lost most of the power in my left hand and no feeling. since they got contact from my Solicitor thats when everything has gone sour and most likely the reason why they wouldn't give me an interview. thats the full story
