Adult caution and summons

    Hi Folks,

    Here is a scenario. I was arrested for a non violent offence ( basically a thing of nothing that ended up being something because I was drunk and mouthed off when guards arrived) whilst extremely drunk ( no excuse, but had a serious drink problem) and was given an adult caution. This was around 4 years ago. I don't remember all the details, due to being so inebriated, but do recall them saying that I would be contacted by a superintendent to receive caution. Not sure if I signed the form they gave me.

    Heard nothing about it and figured that they had forgotten about it as it was a small thing. About two years ago I got arrested again, again for being seriously and dangerously drunk basically. The sergeant at the Garda station said that I had been given an adult caution already, and that a summons had been issued to me for a court date in relation to the previous offence, and that usually an adult caution can only be given once. They did give me an adult caution on this occasion and the superintendent phoned me the next morning to come in and gave it to me.

    My question is, is there likely to be something hanging over my head due to the summons, which i did not receive? What should I do?

    Paragraphs yahey! You did lose me at the end though. I'm getting that you got a caution then got nicked again, 2 years ago, and they said a summons for that nicking was in the post.

    Did you then receive a phone call in relation to the most recent nicking or where you referring to the first nicking?

    Apparantly the summons was for the first occasion, though I did not receive it.

    Got a phone call to go to station re the second time, to receive the caution.

    I'm very confused. Try making an appointment with FLAC and having a word with a solicitor there.

    So why was he told he had a caution previously? You're suggesting he was cautioned and summoned for the same offence?

    Read between the lines.

    Unless your point is that the original caution is somehow invalid, and therefore does not apply.

    And you can read:

    "The sergeant at the Garda station said that I had been given an adult caution already" and read between the lines that the Sgt. checked.

    What's your constructive advice to the OP?

    It was perfectly clear and the OP responded with the requested information that still didn't clear up the issue. Perhaps we'll leave it there.

    I'm sure you have your little quirks over in motors, here it's people registering (as you'll see the OP has done) to ask a question here and posting a wall of text with no paragraphs and ignoring the charter (neither of which the OP did).

    You've still not posted any real practical advice to the OP just continued to try and score points, which you've pretty much failed at given that you tried to give me a reading lesson and failed at it yourself. As for obfuscation the OP doesnt seem confused, as for playing to the gallery - a tad hypocritical don't you think?

    If the OP had a problem with my posting style I'm sure they're a big boy/girl and can deal with it themselves.

    Here's some practical information OP

    go to the citizens information page and search for 'Adult Cautioning Scheme'. This will give accurate information on how the scheme works.

    Summons (for such 'summary' or minor offences) must be issued within six months from the date of the alleged offence so if you do get a summons in the post contact a solicitor or FLAC asap.
