what happends when you cut off a public clamp?

    I got clamped in front of my drive way. I cut the clamp off. Will they bring me to court?

    Whose clamp was it? Did you damage it? Assuming you did if you cut it.

    shouldn't make a difference if anyone seen you, they'll have all your details taken anyway.

    Would it be a council clamp or a management company? You'll know this from whats on the van that does the clamping.

    Yeah I wonder would the person whoes car was clamped have a motive? They would hardly be the prime suspect would they?

    Guy in work cut off 3 a few months ago in a 2 week period, they were council ones and he never heard about it.

    I know they have my details, clamp is fine only the lock was cut off and got rid of ie no evidence. It's council clamp. Can I not just ignore it and say, what clamp? I saw no clamp I.e. Some passer by must have taken it off?

    you gave the clamp back? there is your second mistake.

    the first was removing a public clamp.

    They'll usually fine you about a grand if they take you to court.

    No you aren't as the fine for illegal parking needs to be paid; ignore it and it will end up at district court if you don't address it soon. Cutting off the lock or clamp may be considered as criminal damage. While it may be harder to prove it at Garda level that you did it rather than just going with hearsay and assuming same, the prosecuting judge for the parking offence may take a dim view of hearing about a damaged or removed clamp. You should consult a solicitor about this if you want to make things easier in the long run.

    No you aren't as the fine for illegal parking needs to be paid; ignore it and it will end up at district court if you don't address it soon. Cutting off the lock or clamp may be considered as criminal damage. While it may be harder to prove it at Garda level that you did it rather than just going with hearsay and assuming same, the prosecuting judge for the parking offence may take a dim view of hearing about a damaged or removed clamp. You should consult a solicitor about this if you want to make things easier in the long run.

    i wouldn't have given them the clamp back, thats for sure.

    If you were going to play the "what clamp" card, which in itself is very stupid, you shouldn't have left it there.

    Good luck OP, I'd be waiting for a letter and trying to plague ignore and offering to pay the fine for illegal parking. I doubt you'll have this option any more however.

    I doubt he's a clamper, he's just not as thick as two planks and understands the difference between a council clamp and a private clamper. The council will pursue you for both the parking violation and criminal damage to the clamp. You'll probably come back from holiday with a penal warrant for you to be lodged in prison. Enjoy.

    This was the point I was trying to make too. You damage coucil property, you get fined.

    Hey listen, you've obviously broke some sort of law, life just couldn't be that 'simple'...
    Try sort it before you go away, or as others have said, you may get a rude awakening when you get back or even a few calls when your away!
