SORD problem

    I convinced my Dad last year that he should declare his Rover P6 off road.

    One year later, and going by the advice that the Council would issue a renewal notice in plenty of time to declare it off road again, he waited for this to arrive.

    The first and only notice that arrived was a Final Reminder. This was a month past the off road declaration date!

    He wrote off to the Council, explaining that the car is still off road, sent a completed renewal form and pointing out that they hadn't issued a renewal notice in time for him to renew the off road declaration.

    They wrote back, ignoring all of this, and are looking for €16 for the arrears period and one years tax at €56.

    He is thinking of writing back to contest it.

    Has anyone any thoughts?

    Obviously keep an eye on the date of any off road notices and get them sent off in plenty of time.

    we had a renewal come thru in plenty of time.just declared it off road for another year.i wouldn't pay it I get p'd off enough with people ripping us off.ask for proof it was sent to you.

    If this was challenged in court how could one fail. It's a silly system . If it's declared off the road the why a need to renew it? It's the ''catch'' , another way to rob the blind

    Obvious (and quite beneficial to you) solution is that he transfer it into your name and you declare it off road. There will be no arrears that way. Always fancied a P6 myself

    you will probably end up having to pay the arrears for the period of time after the initial Off the road Declaration ran out, but I don't see why they are demanding you pay a years tax.

    However, they may automatically send you out a tax renewal form once the off the road decleration lapses, this gives you the option of paying the 56 euro for the years tax OR using the online pin (if one is printed on the form at all) to declare it off the road again online. If no pin is printed you have to fill the form

    The problem is the haven't sent the reminder out, and they ought to do something about it in circumstances where it obviously hasn't either been issued or received.

    Q9 says they should get a reminder and without it, doesn't make it easy to make a further declaration.

    Q19 says what happens when arrears are applied. If a declaration expires and nothing is done, arrears start to be applied. At that point there is no choice of just paying the arrears and moving on with another declaration. You've got to stump up the arrears plus 3 months tax before you can make a further SORD. In the case of vintage rate, because of the amount being under the threshold €119 (or whatever it is), you can only get a 12 month disc.

    A challenge has to be made, as it's absurd that you should get caned for what is a failing on their part.

    What happened in the UK (before infinite SORN was introduced recently)where there is no payment required for vintage vehicles, if you forgot to renew it what happened?
    A case of Ireland trying to copy something that was never the same in the first place.

    Change of ownership is the best route here I think. Sord it for a year and then transfer it back.

    You got a £80 fine in the post regardless of the taxation class the vehicle was in (and still do).

    Also these days, if it isn't on SORN, it has to be insured (Continuous Insurance Enforcement). Forget the SORN (e.g. tax still to run out) and have no insurance and expect a £100 fine in the post. Persist and it's clamp, seize and destroy time.
