Consequence of fake loan payments

    Hypothetically speaking.

    What might be the likely consequences if person A was taking money from person B for a bank loan which no longer existed, while threatening person B by refusing access to their children if weekly payments were not met and where a falsified foreign loan account balance were provided when proof of loan was requested? The above scenario assumes that cash payments were given and some text message and social media proof of payment requests exist.

    You'd need a lot more detail, context and background to say with confidence what might happen, but from what you say there are real possibilities of fraud and/or forgery charges. Serious stuff. Go and see a hypothetical lawyer.

    In the hypothetical scenario? I would say, yes. I was just wondering if someone found themselves in such a sensitive situation, (with fathers rights being so poor here in Ireland) what would be a likely outcome for person B.

    See resulting trust, and consider taking solicitors advice re action for recovery of money, depending on feasibility of action, which may be dependent on the amount(s) involved.

    Also worth taking advice re access, custody and the almost inevitable response of an application for maintenance.
