does a separation agreement have to be be one from the courts to count for social welfare reasons, what if its a mutually agreed document - what's known as a deed of separation?

I am recently separated, amicably with no dependent children. Have made claim for JSA and supplementary welfare while waiting for JSA claim to come through.

Have been turned down for supplementary welfare on grounds my seperation agreement is not a court ordered legal seperation or a divorce and that thus my ex's means are my means

The inspector from my JSA claim has also asked me for legal separation documents which I don't have but I am still awaiting her decision.

Any one know anything about this situation?

As far as I understand things the agreement doesn't have to be a legal one at all.
