    so me and my oh n daughter live together. hes on disability for mental illness hes been in hospital for it for about 5months over the last year. I work part time guaranteed 20hours but I usually work more if they are there and for obvious financial reasons I have to take these. we pay 650e rent a month. I have a car loan and he has a small credit union loan. we are struggling with him on disability and myself earning about 340 a week depending on my rota. we got a letter in the door today requesting 2 payslips from me. my last 2 payslips have been fairly high. im just wondering will his disability be cut? and by how much?

    Can we take it that disability allowance is involved here.

    Did you notify the Disability Allowance that you are working, soon as you started working?
    My partner is also on DA and when I got a job we let them know straight away. They wanted a copy of my contract but also a copy of first payslip. I too had a 20 hour contract job but over a year it worked out to about 350 average a week. They asked for more payslips about 6 months later. They cut her allowance down to about 150 a week (including the dependent child 30 ish a week).
    Make sure you keep note of exactly what you send them and when you sent it. And give them a call a few days after sending it to make sure they got it, and ask the person's name that you are talking to. Make a note of all these. They often claim they dont receive letters, but really they do and it gets misplaced between all their different departments.

    Edit: Forgot to say that if you didnt notify them that you started working then they will backdate and claim whatever extra amount back from you for each week that you have been overpaid.
    With us they claimed they never got the letter notifying them, then after 6 months they asked for payslips and claimed we never notified them and told us we owe them around 5000 euro. We managed to convince them they had it wrong so they dropped it. Thats why you have to keep a note of every time you call or mail them.

    for the moment send the 2 lowest consecutive payslips in the last couple of months. Then go to the citizens advice center and ask them what the going rates are,

    Would it make a difference if I sent them a copy of my contract saying I am only guaranteed 20hours? Or would I be just wasting my time?

    They will ask for a copy of your contract anyways. But they wont accept only that as proof of income, definitely will want payslips too. They know there are plenty people on 20 hour contracts who dont actually work only 20 hours.

    This is from citizens information and should be how they calculate your partner's weekly allowance based from your average weekly income:

    Income from spouse's, civil partner's or cohabitant's work

    If your spouse, civil partner or cohabitant works it can affect your Disability Allowance.
    Your spouse, civil partner or cohabitant's weekly earnings (from employment, including rehabilitiative employment) are assessed as follows:
    Weekly earnings are gross earnings less PRSI, superannuation (pension payments) and union dues.
    €20 per day (up to a maximum of €60) from work is deducted from your spouse, civil partner or cohabitant's average weekly earnings and then 60% of the balance is assessed as weekly means. The weekly means is then deducted from the combined total of your personal rate of Disability Allowance and the maximum Increase for a Qualified Adult and any Increases for Qualified Children (if applicable). This formula does not apply to income from self-employment (all income from self-employment is assessed and there are no disregards).
    If you were getting Disability Allowance before 26 September 2007 and you were still in payment on 26 September 2007, your spouse, civil partner or cohabitant's earnings will be assessed under the new means assessment to find out whether you are better off. If you would get a greater amount of Disability Allowance on the previous assessment then you will continue to be assessed using the previous method of calculating means from employment.
    If your spouse, civil partner or cohabitant's means have changed, for any reason, since 26 September 2007, you cannot apply the previous method of calculating means from employment.
