Site boundary with road - group water scheme pipes

    Hi, I have 2 questions,

    1. I live in rural area and was just wondering if someone can confirm who owns the area between my fence and edge of road ( approx 8ft wide).

    2. We are on a private group scheme for water, and this week the scheme have started to upgrade the pipe work (without giving any notice to any house on our road!!). Anyway, we put tarmacadam down recently and this extends out to road edge from the piers. The problem now is that some of this will be dug up to accommodate the new pipes. Can they dig this up without my permission? If they do dig it up, how can I ensure they will re-tar and bring it back to how they found it? Can they say that as tar extends beyond piers out to road edge that this is not my part of my property.

    You own to the centre line of the road, as far as I am aware. Certainly when rates were payable on agri land, the rateable area comprised of the road to the centre line.

    You should ring the Secretary of the group water Scheme at once, before digging takes place. Clarify whats going to happen to your tar-mac.
    Get it in writing.
    I expect that tarring this area was part of the conditions of your planning permission.

    (if you did not own this strip of land, between your gates/fence and the roads edge, your property would be land locked)
