Quick question: in response to a Garda appeal on Twitter regarding a recent high profile incident, which included a CCTV still someone named a person. Despite being asked to delete the tweet and contact them directly, he refused to saying that the person should be named and shamed. Assuming that the person named gets charged, has the tweeter just given the defence there first strategy i.e. a fair trial isn't possible because the tweet could prejudice a jury?

Very possibly. Also if he's not charged, I wouldn't want to be on the receiving end of that defamation action.

Yes, there is the potential to prejudice a case, however the time-line, proximity, etc. will be relevant.
