    Hello,

    I'm in the process of signing a lease for an apartment within a block of flats who has a management company running it. There's no mention of this management company in the lease. Does this have any implications? should they have included the management company in the lease? Any help is appreciated. Thanks

    No. The management company is irrelevant to tenants. You are leasing from the owner, and all your dealings are with them.

    You should be aware of the following

    (10) It shall be a term of every letting of a unit in a multi-unit
    development that the letting is subject to the observance by all those
    occupying the property (including their licensees, servants or agents),
    in whatever capacity, of—
    (a) the conditions and covenants in the title documents relating
    to the use and enjoyment of the property, and
    (b) house rules made under this section,
    and a summary of such relevant conditions and covenants together
    with a copy of any house rules shall be incorporated into the letting
    agreement relating to the unit concerned.

    Ask the landlord to prove that he is up to date with his fees for the management company.

    Otherwise you may find that your access to the apartment(i.e key fobs etc)/other services will be removed, through no fault of your own.

    That's a fair point in theory but in reality the landlord can tell tenant to go jump. It's like asking landlord to provide tenant with landlords bank statements or credit rating - none of tenants business.

    the contract between the unit owner (landlord) and OMC is private and confidential. The contract between you and the landlord is separate.

    However, your enjoyment and rights of access are dependant on the unit owner paying his fee's.

    The vast majority of landlords know this and want to have stable rent paying tenants. The risk is very small.
