Parking fine for loading bay, didn't see the marking on road

Just got a fine in Wicklow today for parking in a loading bay. Had no clue it was a loading bay, as there was already a car ahead of us seemingly parked on top of where it said 'loading bay'. I just saw the end of the double yellow and that was it.
Google street view confirms that it is marked all right.
    Any way out of this?

If you parked in the bay when it was in service as a loading bay then your way out is to pay the fine and save yourself a day in court. The auld "I didn't see it" won't work here.

Was there no signpost indicating it was a loading bay and what times it is in effect?

Going by Google street view there is a tiny sign all right, roughly the size of a stamp.

Judging by that, the car in front of you parked over the loading marking on the road, and you parked directly under the signpost, that you ignored?

No way out of it. Pay the fine and move on.

    So there is a sign?

And a pretty standard one at that. Suck it up, OP.

wtf? the sign is well ahead of where we were. We were behind the other car

Were you parked in the loading bay or not?

You came asking for advice and get a bit cranky...You were parked in a loading bay, regardless who was parked in front or behind you. It's not worth the hassle of court. The sign is visible as are the signs for clamping and disabled parking you could argue them but you'd be in the wrong also. Just pay the fine and be more aware in future.

So then your original post was incorrect? The previous car parked under the loading bay sign and you parked over the word "loading" on the road?

Again, nope, no way you can get out of it. Pay up, move on.

Same thing happened me a few years back. Didn't see loading bay markings, they were badly worn. Put my pay and display on the dashboard, came back to find the parking ticket on car.
I put in an appeal to the council and took some photos showing that the markings were badly worn. Also put in a the pay and display ticket I had on dash of car.
Told them if I was going to knowingly park illegally I wouldn't have bothered paying to park there.
They let me off with it.
Try appealing to your local council, if you have your pay and display ticket, you should be able to convince them that you made a mistake.

In hindsight behind is ambiguous. I meant behind as in to the right from the street view angle. But I do appreciate the feedback.

    Hi O.P.,

If you try posting in the After Hours Forum you just might happen to fall on a variety of people's experiences with something like this if it has happened to other folk. : ) Although AH is a random raucous crazy place, sometimes some of the varied Threads in there do bring about a wide range of well-thought-out interesting differing responses other than AH-type expected responses, so they might / might not be of interest to you - it might be worth a shot, rather than a legal viewpoint.

And road-markings are sometimes absolutely diabolically faded however it is let happen I don't know, but it shouldn't be. I often come across a lot of Yield spots locally and only for knowing the area the markings tend to be practically non-existent.

Yes, but unless I am fundamentally missing something, there doesn't seem to be anything wrong with the markings to which the OP refers.

Really happy to see a clamp down on cars parking in the loading bay and disrupting genuine commercial deliveries etc. Here's hoping it continues.

There is a sign op, you haven't a leg to stand on.

I'd love to see the size of envelopes you use.

So did you have a pay and display ticket on your dashboard, and make a genuine mistake, the same as this poster did? If so, you may have a case, if not, pay up!!

Looking at the Google picture (from 2013) the markings are clear enough with the "LOADING" marking clearly visible and the sign notifying you of a loading bay and I assume times it's in use., now not unless an unusually large vehicle was covering the whole area of the loading area I'm sorry but I don't see a case.

    He sure has a case!!

If by 'quashed' you mean 'upheld', then I tend to agree.

No, the fine will be cancelled.

Do parking offences carry penalty points?

  • Closed Accounts Posts: 103 ✭✭Askabout

Not at all, traffic wardens enforce parking laws for the councils, nothing to do with Gardaí or Penalty Points

Lot of those fines aren't worth the paper they are written on to be honest, most people just pay up but there are a lot of loopholes

Except its not useful to you at all. Its one thing having a fine oveturned for a faded road marking, however that road marking is not faded in the link (of course, it might be now), and even if it was there is a very clear and obvious sign to back it up.

By all means appeal your case, but I really dont see how it will be overturned; its clear as day that you parked in a loading bay Im afraid.

It doesnt look like private land to me. If its a council fine then its absolutely worth the paper that its printed on, and quite a bit more besides!

Then not paying this fine is idiotic
    1 The OP won't win
2 It will cost more than paying

    This makes no sense

No sign of the op here for a few days now. I'd imagine it's been paid...

In some cases, yes but I doubt in the OP's case.

"Parking a vehicle in a dangerous position" carries a mandatory court appearance, 5 points and a fine.

Did you pay and then make an appeal?

With all the barbs and jabs in this thread; I did get a bit of a lol out of it being Touche Place the OP parked on.

OP you parked in a well marked loading bay. Pay the fine or don't it's up to you but you've no grounds for appeal.
